Any private container located within the City af Denton for use in waste and recyclables collection services is required to be permitted. Permits for collection and transportation services are required for, but are nat limited to, the follawing wastes and recyclables classifications: • Special Waste • Medical Waste • Hazardous Waste • Grease & Grit Trap Waste • Cammercial and Industrial Recyclable Materials — containerized and baled • Construction and Demolition (C&D) materials, recyclables, reuseables, and discarded C&D materials � Waste and recyclable collection service providers operating in newly annexed areas, or contract service providers for the city • Refuse or recyclables that the City does not collect and transport. • Waste Cooking Oil The persan shall apply for a permit fram the city, and shall pay ihe required applicatian fees at the time of permit application. All permits are nan-transferable and are granted as nan-exclusive service permits. Granting permits will be at the discretion of the City to meet the needs af the community. The permit applicant must pay the required fees, and meet all permit requirements prior to the issuance af a permit. Applicants with a Texas Cammission of Environmenial Quality (TCEQ) paor compliance history may nat be permitted. Granting af Permit As a condition of granting a permit, the persan or entity receiving such permit (permittee) agrees to execute and comply with all requirements of the service agreement, carry specific types and amounts af insurance, submit reports, and pay the necessary fees by the specified due date. Fallowing the granting of a permit, permit stickers shall be issued by the City and shall be placed by the permittee on all vehicles aperating within the city limits af. Colleciian and transportation vehicles operating in Denton are required ta display a current and valid calendar year permit decal at all times. If decals are lost by the permiitee, and are not visible on their vehicles, then the vehicles must be re-permitted by the permittee, and all appropriate fees paid, prior to the vehicles or cantainers being placed in service within Denton's city limits. The City of Denton is nat responsible for last decals. Exclusians Individuals living within the City limits af Denton, and hauling personal materials, wastes, or 34 recyclables from their primary living residence are exempt from this requirement. Any persan, who transports applicable materials three ar fewer times per year, shall register with the City an the forms provided for that purpose. No annual service fees are required, but registration and permitting thraugh the City is required. Fees Collectian and Transportatron Services Permrt Fees Service Providers Application Fee Paid Annually $200.00 Service Fees: Per Vehicle $400.00 Waste manifests; Per Book of 100 $40.00 Service praviders desiring ta pravide services in mare than one service category are required to camplete permit documentation and pay the applicable fees far each service category they desire to provide within Dentan's City limits. All fees paid are nanrefundable. Applicatian and service fees will be billed to the applicant thraugh City af Dentan's Customer Service Department. Service fees are non-transferable between vehicles and are unit specific. �' � � � � 1• i A business which has nat been permitted by the City to operate within the City limits af Dentan; or has been suspended by the City from aperating within the City limits af Dentan, Texas shall be charged a sum of up to $500.00 per day by the City, for each day of violation af this ordinance, if the provider violates the `No Operatians' requirement priar to receipt af a City af Denton permit, or during any suspensian af a permit period. Each day of illegal aperatians during a`No Operations' period is considered a separate violation and the service provider is subject to being charged a sum of up to $500.00 for each day af violation. Following the receipt af a`No Operatians' declaration and prior to a service provider being reinstated to legally operate within the City limits of Denton, the service provider must meet with the City staff to update their application and agreement and make payment af all manies owed to the City. If a service pravider aperates a vehicle within Dentan's City limits which has not been permitted, operates any piece af equipment with an expired permit, performs some other permit violation, fails to make payment of the appropriate fees in a timely manner, the city will issue a`Na Operations' declaration ta ihe service pravider, and assess all applicable permit violatian fees. Once a service pravider has been issued a'No Operations' declaration from the City, all services ta be provided within Dentan's City limits are required to cease. Following a meeting with the City staff, and the payment of all monies owed the City, the status of the permit will be determined. I � � � � � �, � . � � . If the City finds any requirement of the permit has been vialated, or observes service providers operating within Dentan's City limits withaut current permits, the City may institute a`No Operatians' declaration. Additianally, the City may revoke ar not renew the service provider's permit, thereby requiring the service provider to cease all operations within the City limits af Denton. � . � � R . � 1 Recyclables containing ten (10%} percent ar more contamination, as determined by the City, will be considered refuse, and its collection may not be provided by service providers permitted under this ardinance. This material shall be reclassified as refuse and will be callected by the City af Denton, The Director af Salid Waste or his/her designee, will make the final determinatian an whether stored recyclables contain excessive cantamination, which at the City's determination, may cause the reclassification of these materials to municipal solid waste (MSW}, thereby negating the ability of a service provider to transpart this material within Dentan's City limits under their aperating permit pursuant ta this ordinance. The City of Dentan has the authority to inspect the contents af any container located within Dentan's City limits in arder ta determine the materials content of the cantainer, so as ta ensure compliance with the cantamination requirements, which shall not exceed 10%. �' Permits are issued annually, beginning December l, and are effective fram January 1, or the date of issuance, whichever is later, thraugh December 31 of the same calendar year. The permit applicatian pracess should be initiated and fees should be paid as early as possible during the last quarter of each calendar year for the upcoming calendar year so that adequate time is available for review and processing of the applicatian. All callectian and transpartatian permits shall be valid far up to one calendar year from the date af issuance. If a customer service request for a special or unusual service not otherwise provided far by the Wastewater rate ordinance, and/or requires facilities and devices which are not normally and readily available at the location at which the Customer requests the service, then the City shall provide the service subject to the requirements af paragraph 2 and 3 of this rider. (2) The tatal cost of all facilities required ta meet the Custamer's special requirements which are incurred by the City in connection with rendering the service, shall be subject to a contract entered into between the City and the Customer. This contract shall be signed by both parties priar ta the City praviding the requested service ta the Custamer. (3) Any contract under this rider is subject to the following approvals: (a) If the total value af the cantract is less than $100,000, the contract may be appraved by the City Manager, ar his designee. If a contract under this subsection is nat approved by the City Manager, ar his designee, then it must be recommended for appraval by the Public Utilities Board and approved by the City Council. (b) If the total value of the contract is equal to or greater than $100,000, the cantract must be recommended far approval by the Public Utilities Board and approved by the City Council. CI�7 TION 2. All ordinances or parts of ordinances in force when the provisions of this .S.E.C..... ordinance became effective which are inconsistent, or in conflict with the terms or provisions contained in this ordinance are hereby repealed to the extent of any such conflict, SECTION 3, If any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstances is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity. SECTION 4.
