WHEREAS, Carmel Villas, LLC, a Texas limited liability company ("Carmel Villas"), has
represented ta the City that it is the owner of the property tract subject to the Holigan Easement;
and

WHEREAS, Flowers Baking Campany of Denton, LLC, a Texas limited liability company
("Flowers"), has delivered to the City a 3.154 acre Electric Utility Easement conveyance
instrument, executed on behalf of Flowers (the "Alternative Easement"), as replacement for the
Abandonment tract presently under consideratian; and
WHEREAS, City staff has reviewed the easement abandonment request and finds the
offered Alternative Easement is superior to the Abandonment Tract in respect to the construction,
operation, and maintenance of the future 138kV electric transmission line circuit, slated to connect
the Pockrus-Page electric substation to Spencer electric substation; and

WHEREAS, upon further staff investigation and due diligence about the suitability for
public park use and programming of the offered Holigan park dedication tract, it was found the
nature and characteristics of the offered park tract would not be satisfactory for acceptance as a
public neighborhood park tract; therefare, the park land dedication requirements associated with
the subsequent Holigan area development(s} were fulfilled alternatively; and
WHEREAS, there has yet to be constructed any public improvements or electric facilities
within the Holigan Easement; and
WHEREAS, the Alternate Easement satisfies the future requirements of the Electric Utility
Department and the Hike and Bike Trail easement grant embodied within the Holigan Easement
is no longer a viable concept, the City Council of the City of Denton finds it is in the public interest
to release, abandon, and vacate its interests in the Abandonment Tract; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The recitations and finding set forth above are incorporated by reference,
SECTION„2,, The Abandonment Tract, that 3.625 acre portion of the Holigan Easement,
as described in Exhibit "A" and depicted on Exhibit "B", both attached to this ordinance and made
a part hereto for all purposes, is hereby abandoned, released, and vacated.
SECTION 3. The City Manager, or his designee, is authorized to execute a release
document evidencing the abandonment of the Abandonment Tract suitable for recordation in the
Real Property Records of Denton County, Texas.
SECTION 4. Notwithstanding anything to the contrary contained in this ordinance, the
City of Denton retains and reserves any and all easements, rights of way, and any other rights or
interests, other than the Abandonment Tract released, abandoned, and vacated in Section 2 above,
whether acquired, obtained, owned, or claimed by the City of Denton or public, by, through, or
under conveyance, dedication by plat, or other express dedication, implied dedication,
prescription, or by any other manner or means, in or to lands in which the Abandonment Tract may
cover, encumber, include, cross, or overlap.
_SECTION 5.
The provisions of this ordinance are severable, and the invalidity of any
phrase, clause, or part of this ordinance shall not affect the validity or effectiveness of the
remainder of the ordinance.
SECTION 6. This ordinance shall become effective immediately upon its passage and

WHEREAS, a 5.886 acre easement situated in the Gideon Walker Survey, Abstract No.
1330, was granted ta the City of Dentan by Haligan Land I7evelopment, Ltd., recorded as
Instrument Number 2005-140655 in the Real Property Records, I7entan County, Texas (the
Holigan Easement"); and
WHEREAS, on September 18, 2018, the Denton City Council passed and approved
Ordinance No. 18-1474, releasing, abandoning, and vacating its easement rights to a 3.625 acre
portion of the Holigan Easement, as described in Exhibit "A99 and depicted on Exhibit 66By99 both
attached hereto and made a part hereaf far all purposes (the 66Abandonment Tract99); and
WHEREAS, pursuant to City of Denton Ordinance Na. 18-1474, the Denton City
Council authorized the City Manager, or his designee, on behalf of the City of Denton to execute
a Release document, evidencing the formal abandonment of the Abandonment Tract, suitable for
