PDA18-0004bS:tLegat\C}ur pocuments\Ordin�etcestl8\PIiAI�-OQ04, mcrdiiaed and approved Sepi. 1�, 2018.docx •'r . • ' � ` i 11�� r AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING A DETAIL PLAN FOR A 2.13 ACRE PARCEL LOCATED WITHIN THE PLANNED DEVELOPMENT 176 (PD-176) ZONING DISTRICT, GENERALLY LOCATED ON THE WEST SIDE OF NORTH FM 2499, APPROXIMATELY 760 FEET NORTH OF HICKORY CREEK ROAD 1N THE CITY OF DENTON, DENTON COUNTY, TEXAS, TO ALLOW AN AUTO LAUNDRY FACILITY; PROVIDING FOR A PENALTY 1N THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. (PDA18-0004) WHEREAS, MJ Thomas Engineering, on behalf of Clean and Green Carwash, has applied for a Planned Development Amendment on approximately 2.13 acres of land legally described and depicted in Exhibit A, attached hereto and incorporated herein by reference (hereinafter, "the Property"); and WHEREAS, on August 3, 1999, by Ordinance 99-257 the City Council approved a change in zoning for 65.17 acres of land in Planned Development 172 (PD-172) zoning district; and WHEREAS, On October 5, 1999, by Ordinance 99-367, the City Council established Planned Development 176 (PD-176), approved general development standards for PD-176, and approved the Concept Plan for 16$.57 acres af land located within the PD-176 zoning district, and WHEREAS, The Cancept Plan designated the subject property as part of Tract 3, which was designated for commercial development, and WHEREAS, on Navember 2, 1999, by Ordinance 99-405, the City Council approved a change in zoning far 38.6 acres of land in Planned Development 170 (PD-170) Zoning District; and WHEREAS, on June 20, 2000, by Ordinance 2000-216 the City Council approved a Detailed Plan for residential uses on 253.36 acres located in the PD-170, PD-172 and PD 176 Zoning District which speciiically excluded Tracts 1 and 3 as shown on the Concept Plan approved by Ordinance 99-367; and WHEREAS, an July 25, 2018, the Planning and Zaning Commission conducted a public hearing as required hy law, and recommend approval of the requested Detailed Plan with canditions [4-0]; and WHEREAS, the City Council likewise held a public hearing on August 21, 2018 and September 18, 2018 and found that the Detailed Plan is consistent with the approved Concept Plan for PD-176, the Denton Plan and the Development Code, and approved subject to satisfaction of certain conditions of appraval; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. That the Detail Plan for the subject Property, located within Tract 3 of Planned Development 176 (PD-176), is attached hereto and incorporated herein by reference as Exhibit B, and is hereby approved, subject to the following conditions: 1. No exterior lighting on the building shall face a single-family residential use, or if such lighting is proposed, it shall be screened from view of adjoining residential properties. A photometric plan shall be provided with the building permit application demonstrating compliance with the DDC's site lighting requirements in Section 35.13.12. 2. Due to the proximity of this location to single-family residences, the majority. of the PD being residential, and the lack of signage regulations in the PD, the project shall comply with the Code of Ordinances sign requirements for non-residential districts as well as the following limitations: a. No illuminated wall signs may face an adjoining single-family use. 3. The height of the proposed masonry screening wall shall be 6 feet. 4. Hours of operation shall be limited to 7am to 9pm daily, 5. The centralized vacuum motor shall be interior to the structure and sound-proofed to limit noise to surrounding properties. Prior to application for building permit, Staff shall approve a redesign of the site that includes the same development elements detailed in Section 2 below, provided however, the layout and location of the building, solid waste enclosure, vacuum equipment, and vacuum stalls shall be relocated on the north side of the building to provide additional separation from the adjacent residential properties to the south. ��� �." [�C°.��C "�. °�'he site plan, landscape plan, and building elevations provided in the Detail _.._ Plan specify the following: 1. The detail plan specifies the total building square footage at approximately 4,478 square feet with a maximum height of 30 feet. 2. The detail plan specifies a total of 5 parking spaces and 25 vacuum stalls, 5 of which are intended for future construction. 3. The detail plan specifies approximately 20-foot wide landscape buffer containing existing trees, 8 new tree plantings, and a masonry wall as described in the conditions set forth in Section 1 of this Ordinance. 4. The detail plan specifies a total of 27 new trees and 33 new shrubs to be planted in accordance with the Landscape Plan. 5. The detail plan specifies a maximum lot coverage of 60.7%, once the five future vacuum stalls are provided. �E C� 1�?� ;�, The provisions of this ordinance, as they apply to the 2.13 acres shown in the Detail Plan herein approved, shall govern and control over any conflicting provisions of Ordinance No. 99-367, but all provisions of Ordinance No. 99-367, as they apply to that remaining portion of the district not herein amended, shall continue in force and effect, and shall apply to the remainder of said district. SECTION 4. That a copy of this ordinance shall be attached to Ordinance No. 99-367 showing the amendment herein approved, �C-���"Y"rC�� �, If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of the provisions or applications, and to this end the provisions of this ordinance are severable. � 0"i 'l�!(:;)]"�ii �.
