" � � f', WHEREAS, Section 2-29(g)5)(a) stipulates that matters voted on by the City Council which end in a tie-vote shall automatically be placed on each subsequent council meeting agenda until a full council is present; and WHEREAS, on September 25, 2018, the City Council in accordance with Section 2- 29(g}(5}(a} continued to consider the Specific Use Permit request and the City Council hereby finds that the request is cansistent with the Denton Plan and federal, state, and local law and that the Applicant has agreed to comply with all provisions of the Denton Development Code, as they exist, may be amended, or in the future arising, including but not limited to, this Ordinance, and has further agreed to comply with the additional restrictions and conditions set forth herein; and WHEREAS, the City Council has determined that it will be beneficial to Denton and its citizens to grant the SUP; that such grant will not be detrimental to the public welfare, safety, or health; and that the SUP should be granted; NOW THEREFO , • # # � • ' : •'�� • . r , , • � . � � . -� _•'. •'� �� . .�. w •� . -• r . • • �' • �- The provided preliminary site plan, landscape plan, and building elevations shown in Exhibit "B" are generally consistent with the requirements of the Denton Development Code in terms of site design, landscaping, parking, and building design as pravided in DDC 35,6.3. The final site plan, landscape plan, and building elevations shall be consistent with the approved preliminary plans and elevations. 2. The rent grid, attached as Exhibit "C", shall be attached as an exhibit that will be part of an agreement between Integrated Real Estate Group, or its successor or related or affiliated entity and Premier Denton Public Facility Corporation, as referenced by the Applicant and its representatives at the City Council's meeting on September 25, 201$. SECTION 3. The preliminary site plan, landscape plan, and building elevations provided in Exhibit "B" specify the following, and area incorporated as requirements of the SUP: 1. The preliminary plans specify approximately 95,665 square feet of building foatprint with 5,100 square feet of commercial space, and the balance being multi-family. 2. The preliminary plans specify 270 multi-family units, comprised of a mixture of 1-, 2- , and 3- bedroom units. 3. The preliminary plans specify approximately 471 parking spaces. 4. The preliminary plans specify a 2.5 acre "Tree Conservation Area". 5. The preliminary plans specify a tatal of 84.2% lot coverage and 15.8% landscape area, which includes a 15-foot wide Type "C" landscape buffer along the northern and southern property line. 6. The preliminary plans specify two four-story buildings constructed with facades of brick and stone veneer and fiber cement siding/panels.
