18-1613AN ORDINANCE OF THE CITY OF DENTON, TEXAS, A TEXAS HOME RULE
MUNICIPAL CORPORATION, AUTHORIZING THE CITY MANAGER TO
EXPEND FUNDS FOR PAYMENT BY THE C1TY OF DENTON T O T H E T E X A S
COMMISSION ON ENVIRONMENTAL QUALITY FOR THE ANNUAL
CONSOLIDATED WATER QUALITY FEE FOR OPERATION OF THE PECAN CREEK
WATER RECLAMATION PLANT; AND PROVIDING AN EFFECTIWE DATE
(CONS OLIDATED WATER QUALITY FEE IN THE TOTAL N Q T- T O- E X C E E D
AMOUNT OF $115,000.00).
WHEREAS, Section 26.0291 of the Texas Water Code requires each wastewater
discharge permit holder ta pay a Water Quality Fee in order for the State to cover casts af
inspections and enforcement of the Water Code; and
WHEREAS, the City of Denton operates the Pecan Creek Water Reclamation Plant
within the City of Denton and holds a wastewater discharge permit for such operation; therefore,
the City of Denton is required ta pay such fees imposed by the Texas Commission on
Environmental Quality; and
WHEREAS, the City Manager recommends that the City Council approve and authorize
the payment of these required fees to cantinue wastewater plant operation; NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION l. That the expenditure of funds in an amount not to exceed $115,000.00
shall be paid to the Texas Commission on Environmental Quality upon receipt of the annual
invoice, which is typically received in October.
