WHEREAS, pursuant to Section 17-20 af the Cade of Ordinances af the City of Denton,
The Village Church Denton has made an application ta the City Cauncil for an exception to the
pravision restricting hours of aperation for an outdoor event, in cannection with the church service
at Sauth Lakes Park, from the limitations imposed by Sectian 17-20 af the Code of Ordinances of
the City af Denton, granting a variance in hours of aperation for amplified sound levels for an
outdaor event from 10:00 a.m. ta 11:00 a.m. on Sunday, October 21, 2018;and
WHEREAS, upon prior application and approval by the City Council of the City of Denton,
The Village Church Denton has consistently demonstrated an ability ta responsibly host a church
service in Denton parks, on a day restricted in Section 17-20 of the Code of Ordinances of the City
of Dentan, Texas, within the public interest, and without materially disturbing persons of ordinary
sensibilities in the immediate vicinity thereof; and
WHEREAS, based upan past history, the City Council of the City of Denton, finds that
granting a noise exception for this event, subject to the restrictians contained herein, would serve
the public interest; NOW, THEREFORE,

SECTION l. Pursuant ta Section 17-20 af the Code of Ordinances, The Village Church
Denton.� ��.������...,�, _ �
is hereby granted an exception to said section's amplified sound prohibitian subject to the
following restrictions:
This exception to the limitations imposed by Section 17-20 of the Code of
Ordinances of the City of Denton, is granted only in cannectian with the church
service hasted by The Village Church Dentan at South Lakes Park.
2. The Village Church Dentan agrees ta take full responsibility for ensuring that the
conditions of this exception are met and ta take all reasonable measures necessary
to avoid disturbing persans of ordinary sensibilities in the immediate vicinity af the
event.
3. The Village Church Dentan agrees to cease using amplified loudspeakers at 11:00
a.m. an Sunday, October 21, 201$.
4. Under no circumstances shall The Village Church Dentan emplay the use of
amplified laudspeakers past 11:00 a.m. on Sunday, October 21, 201$.

7. This ordinance shall be strictly construed as an exception granted pursuant ta
Sectian 17- 20 of the Code of Ordinances of the City of Denton.. The City af
Denton, expressly reserves unto itself and all other persons any and all legal
remedies, civil ar criminal, relating ta excessive noise in connection with this
annual event and hereby disclaims any pramissory, ar equitable estoppel which
might in any way impede the pursuit of such remedies by any person.
SECTION 2. This Ordinance shall become effective immediately upon its passage.
