AN ORDINANCE OF THE CITY OF DENTON, TEXAS, A TEXAS HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZING TH� CITY MANAGER TO �XECUT� AN AGR�EMENT
WITH 380 STORAGE OF DENTON, LLC, FOR WATER MAIN COST PARTICIPATION ��OR
THE OVERSIZING OF WATER MA1NS FOR THE CITY Or DENTON; PROVIDING FOR TH�
EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE
(AWARDED TO 380 STORAGE OF DENTON, LLC, IN THE NOT-'TO-EXCEED AMOUNT OF
$105,679.35).
WHEREAS, the City desires to participate in the cost of oversizing water mains to be
designed, installed, and constructed by the owner of the real property, 380 Storage of Denton, LLC,
in an amount not to exceed One Hundred Five Thousand Six Hundred Seventy Nine 35/100 Dollars
($105,679.35), in accordance with the provisions of Section 35.21.9.1 of the Denton Development
Code, as amended, and Texas Local Government Code 212.072; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The City Manager is authorized to execute a"Water Main Cost Participation
Agreement" between the City of Denton, 380 Storage of Denton, LLC, for the oversizing of
approximately 2,001 feet of twelve-inch (12") to sixteen-inch (16") water mains; substantially in the
form of the attached Agreement, which is incorporated herewith and made a part of this ordinance
for all purposes; subject however, to 380 Storage of Denton, LLC, entering into a Development
Contract with the City of Denton, in accordance with Section 35.16.20.B of the Denton Development
Code, as amended, of the City of Denton, Texas.
SECTION 2, The City Manager of the City of Denton, Texas, is hereby authorized to make
the expenditures as set forth in the attached Agreement.
SEC,TION 3. This Ordinance shall become effective immediately upon its passage and
approval.
