WHEREAS, Vincent G. Huebinger on behalf of Verizon Wireless, has applied for a
Specific Use Permit (SUP) to allow a 70-foot manopole tawer with a ten-foot lightning rod and
associated equipment room on 0.0091 acres within the Downtown Commercial General (DC-G}
zaning district and use classification (the 66Property99), as legally described in Exhibit A and
depicted in Exhibit B; and
WHEREAS, on November 28, 2018, the Planning and Zaning Commission, in compliance
with the laws of the State of Texas; having given the requisite notices by publication and otherwise;
and having afforded full, fair, and legally compliant hearings to all property owners interested in
this regard, recommended approval [7-0] af the requested SUP, subject to the site plan and
elevatians attached and incorporated hereto as Exhibit C; and
WHEREAS, on December 1$, 2018, the City Cauncil likewise conducted a public hearing
as required by law, and finds that the request meets and camplies with all substantive and
procedural standards set forth in Section 35.3.4 of the Denton Development Code, and is consistent
with the Denton Plan and the Denton Development Code; and
WHEREAS, the City Council of the City of Denton has determined that it will be beneiicial
to Denton and its citizens to grant the SUP; that such grant will not be detrimental to the health,
safety, marals, and general welfare of the City of Denton; and that the SUP should be granted as
set forth herein; NOW THEREFORE,

SECTION 1, The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference and found to be true.
SECTION 2. The SUP to allaw the 70-foot monopole tower with a ten-foot lightning rod
and associated equipment room on the Property, is hereby approved, subject to the Canditions in
Exhibit C.
SECTION 3, Except as otherwise stated abave, all terms of the SUP shall be complied
with priar to issuance of a Certifcate of Occupancy. Failure to comply with any term or condition
of the Ordinance will result in the SUP being declared null and void, and of no force and effect.
The SUP is issued to the entity named above, runs with the land, and is assignable and transferable
to subsequent owners of the Property.
SECTION 4. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid by any court, such invalidity shall not affect the validity of the
provisions or applications, and to this end the provisions of this ordinance are severable.
SECTION 5. Any person, firm, partnership or corporation violating any provision of this
ordinance shall, upon conviction, be deemed guilty of a misdemeanor and shall be punished by
fine in a sum not exceeding $2,000.00 for each offense. Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense.
SECTION 6. That any offense committed before the effective date of this ordinance is
governed by prior law and the provisions of the Denton Code of Ordinances, as amended and in
effect when the offense was committed, and the former law is continued in effect for this purpose.
SECTION 7. In compliance with Section 2.09(c) of the Denton Charter, this ordinance
shall become effective fourteen (14) days from the date of its passage, and the City Secretary is
hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-
Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the
date of its passage.
