AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING ORDINANCE 2000-
007 TO PROVIDE FOR AN AMENDMENT TO THE CONCEPT PLAN AND APPROVAL OF
A DETAILED PLAN FOR PLANNED DEVELOPMENT 115 (PD-115) DISTRICT TO DEPICT
A S1NGLE-FAMILY RESIDENTIAL DEVELOPMENT ON APPROXIMATELY 78 ACRES
OF LAND GENERALLY LOCATED WEST SIDE OF NORTH BONNIE BRAE STREET,
APPROXIMATELY 250 FEET SOUTH OF US HIGHWAY 77/NORTH ELM STREET 1N THE
CITY OF DENTON, DENTON COUNTY, TEXAS; AI70PTING AN AMENI7MENT TO THE
CITY'S OFFICIAL ZONING MAP; PROVIDING FOR A PENALTY IN THE MAXIMUM
AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF; PROVII7ING FOR SEVER.ABILITY;
AND ESTABLISHING AN EFFECTIVE DATE. (PDA18-0001)
WHER.EAS, Braewood Partners, Ltd., has applied for an Concept Plan amendment and
Detailed Plan approval on approximately 78 acres of land legally described in Exhibit "A",
attached hereto and incorporated herein by reference (hereinafter, the 66Property99); and
WHEREAS, on May 20, 1986, by Ordinance 86- 101, the City Council approved a change
in zoning for 239.17 acres of land to Planned Development 115 (PI7-115) zoning district
classification and use designation, as more particularly described therein; and
WHEREAS, on January 4, 2000, by Ordinance 2000-007, the City Council approved an
amendment to the Concept Plan for Planned Development 115 (PD-115) zoning district
classification and use designation for 230.11 acres, as more particularly described therein; and
WHEREAS, on January 4, 2000, by Ordinance 2000-008, the City Council approved a
Detailed Plan for Planned I7evelopment 115 (PD-115) zoning district classification and use
designation for 193.88 acres, as more particularly described therein; and
WHEREAS, pursuant to the terms of the zoning ordinance governing planned
developments, the detailed plan incorporated and approved by Ordinance 2000-008 expired
twenty-four months from the date of its approval; and
WHEREAS, on June 20, 2006, by Ordinance 2006-179, the City Council approved a
Detailed Plan for 194 acres, as more particularly described therein; and
WHEREAS, pursuant to the terms of the zoning ordinance governing planned
developments, the detailed plan incorporated and approved by Ordinance 2006-179 expired
twenty-four months from the date of its approval; and
WHEREAS, all portions of the original Planned Development 115 (PD-115) zoning district
classification and use designation, ca�l�c�� �������� the Property legally described in Exhibit A, were
transferred to the Denton Independent School District for a new high school, or were otherwise
rezoned into other zoning classiiication and use designations, leaving the subject Property as the
only remaining component of the previously approved PI7-115 Concept Plan; and

b. The General Concept Plan and Detailed Plan may be develaped in phases. If the
common amenities for future phases, including but not limited to, perimeter
fencing, open spaces, landscaping and/or recreational facilities are not yet
constructed, a phasing plan may be considered as a companent of the final plat. If
provided, a phasing plan shall contain a graphic and narrative document that
indicates the sequence and time of construction, provides a description of the
phasing order (e.g. 1, 2& 3) and includes infrastructure requirements far each
phase, as amended from time to time with appraval of the Director.
c. All required public infrastructure must conform to the minimum standards outlined
in Denton Development Code and Criteria Manuals.
d. Accessory uses and structures must meet Denton Development Code requirements.
e. All open space lots are to be owned and maintained by the Homeowners
Association. At the time of platting, a note shall be added to the Final Plat indicating
apen space ownership and maintenance.
2. Permitted Uses
a. Single-family residential dwellings
b. Open space
c. Parks, playgrounds
d. Home Occupations, as permitted and regulated by the Denton Development Cade
3. Dimensional Regulations
a. Maximum density: 3.6 dwelling units per acre (280 units)
b. Minimum lot size: 6,000 square feet
c. Minimum lot width: 50 feet
d. Minimum lot depth: 100 feet
e. Maximum height: 36 feet
f. Minimum front yard setback: 20 feet
g. Minimum side yard setback: 5 feet
h. Minimum side yard setback adjacent to street: 10 feet
i. Minimum rear yard setback: 10 feet
j. Maximum lot coverage: 60 percent
4. Mability
a. Neighbarhood streets must contain traffic calming devices as required per the
Denton Development Code and Transportation Criteria Manual.
b. Right-of-way dedication for internal street system to be a minimum 55-foot width
c. Sidewalks must be installed on all street frantages.
d. Five foot sidewalks adjacent to internal street frontage to be installed by the
builder at the time of home construction.
5. Open Space
a. Minimum open space acreage: 13.38 acres
b. An open space buffer lot, minimum 20-feet wide, is required adjacent ta North
Bonnie Brae Street along the east property boundary.
c. An open space buffer lot, minimum 15-feet wide, is required around the north,
south, and west boundaries of the site.
6. Perimeter Fencing
a. Six-foot wood fence shall be installed on the north baundary of the development.
b. All perimeter fences and walls must be maintained by the Homeowners
Association.
c. The support structure for perimeter fences may not be visible from the right-of-way
or adjacent praperties.
7. General Landscaping Requirements
a. Street Trees. Medium canopy street trees selected from the Landscape Plant List
must be planted along all proposed neighborhaods streets within the development
at a rate of one tree planted at a rate of one every 45 ta 50 linear feet at the time of
construction.
b. Lot Trees. A minimum of one tree must be planted in the front yard of each
residential lot at the time of construction by the builder. If the frant yard does not
provide sufficient spacing at maturity, the lot tree may be planted in the rear yard.
c. Open space areas must maintain an average minimum 40 percent tree canopy at
maturity, including preserved trees. The minimum canopy may be achieved with a
combination of preserved trees or planted canopy and ornamental trees. The
existing pand and stream will not be included in the open space area for the purpose
of tree canopy calculation.
d. Each single-family lot must maintain a minimum 50 percent pervious area hetween
the front yard setback and the front property line planted with turf, sod, xeriscape,
ar similar permeable planting material.
e. Minimum caliper inches at planting, landscaping maintenance, and irrigation shall
follow DDC requirements.
8. Specific Landscaping Requirements: Sauth Property Boundary
a. Lots that directly side or back the required minimum 15-foot landscape buffer shall
be screened by a minimum 6-foot height wood, board on board cedar fence or other
appraved fencing.
b. Areas along the buffer that are greater than 15 feet in width that are adjacent ta
residential lots shall be screened with an ornamental metal fence, minimum 6-foot
height.
c. Areas along the buffer that open to natural areas will contain no fencing between
the street and natural areas.
d. The owner has the option to place up to 3 monument entry signs with at least one
being a major sign similar to the ane along North Bonnie Brae.
e. The owner shall construct a 5-foot wide concrete sidewalk within the street right-
of-way.
f. In locations where open space exceeds a width of 15 feet, the sidewalk shall
meander within the adjacent natural apen areas.
g. Masonry columns shall be constructed along the wood fence at a minimum spacing
of every 200 feet on-center.
h. Within the required minimum 15-foot landscape buffer, medium canopy trees shall
be planted along the street frontage at a rate of ane- to three- inch caliper tree per
each 45 linear feet. These trees may be clustered or grouped with a minimum
spacing of 25 feet on-center.
i. Areas between the five-foat concrete sidewalk and back of curb shall be planted
with solid Bermuda Sod.
j. Area between the five-foot sidewalk and wood fence may be planted with turf
grasses or other native grass as selected by owner. This area shall be hydromulched.
k. Landscape beds may be utilized along the wood fence.
l. Landscape areas along south property boundary wider than twenty feet may contain
Berms and other land features. These berms shall be constructed at a maximum
slope of 4:1 and approximately 600 feet in length. The Berms and land features
shall be free form and natural loaking with break for view corridors.
m. Areas outside the five-foat wide concrete sidewalk, in the large open spaces, shall
be seeded with native seed. The seed mix shall be a mixture af native grasses and
wildflawers.
9. Speciiic Landscaping Requirements: East Property Boundary
a. Within the 20-foat landscape buffer, a 6-foot tall masonry wall with enhanced
columns at a minimum spacing of two hundred feet on-center shall be constructed.
b. Within the 20-foat landscape buffer/right-of-way, a 5-faat wide sidewalk shall be
canstructed.
c. At the north end of the project along North Bonnie Brae, an enhanced stone and
masonry wall shall be constructed.
d. Within the 20-foot landscape buffer, medium canapy trees shall be planted along
the street frontage at a rate of one- to three- inch caliper tree per each 45 linear feet.
These trees may be clustered or grouped with a minimum spacing of every 25 feet
on-center.
e. Areas between the 5-foot concrete sidewalk and back of curb shall be planted with
solid Bermuda sod.
f. Areas between the 5-faot sidewalk and masonry wall may be planted with turf
grasses or other native grass as selected by owner. This area shall be hydromulched.
g. Landscape beds may be utilized along the masonry wall.
10. Internal Open Space Landscaping
a. Developer, location at his discretion, shall construct an all-weather trail
approximately 600 feet in length, through the selected internal open spaces. The
location shall be determined at time of final plans.
b. Developer shall locate a minimum of iive seating areas, adjacent to the concrete
sidewalk or all weather trail. The seating areas shall consist of natural boulders/rock
sitting areas.
c. Developer shall construct a minimum of one shade structure overlooking the
existing lake. The shade structure shall be a minimum af 200 square feet (10'x20')
and shall include seating areas and a trash receptacle.
d. Developer shall install a dog waste station at a rate of one per 500 linear feet of
sidewalk. The waste statian may be located closer than, but not further than, 500
linear feet spacing, based on layout.
11. Parking
a. Single-family dwellings require 4 parking spaces. Tandem garage spaces within the
garage will not caunt toward minimum.
12. Signs
a. Subdivision monument signs must be constructed with masonry supports.
b. Lighting must be shielded to prevent upward diffusion and glare onto surrounding
residential property.
13. Residential Building Regulations
a. Residential buildings shall utilize at least three (3) of the follawing design features
to provide visual relief along the front of the residence:
i. Dormers
ii. Gables
iii. Recessed entries, minimum of three (3) feet deep
iv. Covered frant porches
v. Cupolas
vi. Architectural Pillars or posts
vii. Bay windows, a minimum of twenty-four (24) inch projection
viii. Separate transom windows
ix. Two (2) types of masonry
b. Attached front entry garages of residential dwellings must be constructed of wood,
synthetic wood, ar stained fiberglass having a wood appearance, and may extend a
maximum of eight (8) feet in frant of the front building wall.
c. All residential dwellings must include a covered front entry ar cavered porch.
d. The same house elevatian may not be used within any eight (8) lot groupings along
a street frontage.
e. Exterior building materials shall consist of seventy percent (70%) Masonry (for the
purposes of this requirementy 66Masonry" means Brick and Stone, exclusively).
Siding may be used in areas that would create a"brick on wood" appearance.
�I � C"it��� �. The pravisions of this ordinance, as they apply to the 7$ acres shown in the
Concept Plan and Detailed Plan herein approved, shall govern and control aver any conflicting
provisions of Ordinance No. 2000-007, but all provisions of Ordinance No. 2000-007, as they
apply to any remaining portion of the district not herein amended, shall continue in force and
effect, and shall apply ta the remainder of said district.
�� � 1�4���;��9 �. A copy of this ordinance shall be attached to Ordinance No 2000-007
showing the amendment herein approved.
��^�C"!"[���I �. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid by any caurt, such invalidity shall not affect the validity of the
provisions or applications, and to this end the provisions of this ordinance are severable.
'��mm�" f°���T� 7, Any person, firm, partnership or corporation vialating any provision of this
ordinance shall, upon conviction, be deemed guilty of a misdemeanor, and shall be punished by
fine in a sum not exceeding $2,000.00 for each offense. Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense.
��:'�i� fl"dC�� �. Any offense committed before the effective date of this ordinance is governed
by prior law and the provisions of the Denton Cade af Ordinances, as amended, in effect when the
offense was committed and the former law is continued in effect far this purpose.
�I:�;i��"�"I��� ��. In compliance with Section 2.09(c) of the Denton Charter, this ordinance
shall become effective fourteen (14) days from the date of its passage, and the City Secretary is
hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-
Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the
date of its passage.

l. Administration Requirements
a. The current City rules and regulations applicable to the development of property
are applicable, except as otherwise provided by this General Concept Plan and
Detailed Plan and further restricted herein and may not be varied or excepted other
than by amendment of these standards.
b. The General Concept Plan and Detailed Plan may be developed in phases. If the
common amenities for future phases, including but not limited to, perimeter
fencing, open spaces, landscaping and/or recreational facilities are not yet
constructed, a phasing plan may be considered as a component of the final plat. If
provided, a phasing plan shall contain a graphic and narrative document that
indicates the sequence and time of construction, provides a description of the
phasing order (e.g. 1, 2& 3) and includes infrastructure requirements for each
phase, as amended from time to time with approval of the Director.
c. All required public infrastructure must conform to the minimum standards outlined
in Denton Development Code and Criteria Manuals.
d. Accessory uses and structures must meet Denton Development Code requirements.
e. All open space lots are to be owned and maintained by the Homeowners
Association. At the time of platting, a note shall be added to the Final Plat indicating
open space ownership and maintenance.

4. Mobility (See Detailed Plan)
a. Neighborhoad streets must contain traffic calming devices as required per the
Denton Development Code and Transpartation Criteria Manual.
b. Right-of-way dedication for internal street system to be a minimum 55-foot width
c. Sidewalks must be installed on all street frontages.
d. Five faot sidewalks adjacent to internal street frontage to be installed by the
builder at the time of home construction.
5. Open Space (See Detailed Plan)
a. Minimum apen space acreage: 13.38 acres
b. An apen space buffer lot, minimum 20-feet wide, is required adjacent to North
Bonnie Brae Street along the east property boundary.
c. An open space buffer lot, minimum 15-feet wide, is required around the north,
south, and west boundaries of the site.
6. Perimeter Fencing
a. Six-foot wood fence will be installed on the north boundary af the development.
b. All perimeter fences and walls must be maintained by the Homeowner's
Association.
c. The support structure for perimeter fences may not be visible from the right-of-way
or adjacent properties.
7. General Landscaping Requirements (see the General Conceptual Site and Landscape
Plan)
a. Street Trees. Medium canopy street trees selected from the Landscape Plant List
must be planted alang all proposed neighbarhoods streets within the development
at a rate of one tree planted at a rate of one every 45 to 50 linear feet at the time of
construction.
b. Lot Trees. A minimum of one tree must be planted in the front yard of each
residential lot at the time of construction by the builder. If the front yard does not
provide sufficient spacing at maturity, the lot tree may be planted in the rear yard.
c. Open space areas must maintain an average minimum 40 percent tree canopy at
maturity, including preserved trees. The minimum canapy can be achieved with a
combination of preserved trees or planted canopy and ornamental trees. The
existing pond and stream will not be included in the open space area for the
purpose of tree canopy calculation.
d. Each single-family lot must maintain a minimum 50 percent pervious area between
the front yard setback and the frant property line planted with turf, sad, xeriscape,
or similar planting material which maintains 100 percent permeability.
e. Minimum caliper inches at planting, landscaping maintenance, and irrigation shall
fallaw DDC requirements.
$. Specific Landscaping Requirements: South Property Boundary (see the General
Conceptual Site and Landscape Plan)
a. Lots that directly side or back the required minimum 15-foot landscape buffer will
be screened by a minimum 6-foot height wood, board on board cedar fence or other
approved fencing.
b. Areas along the buffer that are greater than 15 feet in width that are adjacent to
residential lots will be screened with an ornamental metal fence, minimum 6-foot
height.
c. Areas along the buffer that open to natural areas will contain no fencing between
the street and natural areas.
d. The owner has the option to place up to 3 monument entry signs with at least ane
being a major sign similar to the one along North Bonnie Brae.
e. The owner will construct a 5-faot wide cancrete sidewalk within the street right-of-
way.
f. In locations where open space exceeds a width of 15 feet, the sidewalk will meander
within the adjacent natural apen areas.
g. Masonry columns will be constructed along the woad fence at a minimum spacing
of every 200 feet on-center.
h. Within the required minimum 15-foot landscape buffer, medium canopy trees will
be planted along the street frontage at a rate of one- to three- inch caliper tree per
each 45 linear feet. These trees can be clustered or grauped with a minimum spacing
af 25 feet on-center.
i. Areas between the five-foot concrete sidewalk and back of curb will be planted
with solid Bermuda Sod.
j. Area between the five-foot sidewalk and wood fence may be planted with turf
grasses or other native grass as selected by owner. This area will be hydromulched.
k. Landscape beds may be utilized along the wood fence.
l. Landscape areas along sauth property boundary wider than twenty feet may contain
Berms and other land features. These berms shall be canstructed at a maximum
slope of 4:1 and approximately 600 feet in length. The Berms and land features
shall be free form and natural looking with break for view corridors.
m. Areas outside the five-foot wide cancrete sidewalk, in the large open spaces, shall
be seeded with native seed. The seed mix shall be a mixture of native grasses and
wildflowers.
9. Speciiic Landscaping Requirements: East Property Boundary (see the General
Conceptual Site and Landscape Plan)
a. Within the 20-foot landscape buffer, a 6-foot tall masonry wall with enhanced
columns at a minimum spacing of two hundred feet on-center will be constructed.
b. Within the 20-foot landscape buffer/right-of-way, a 5-foot wide sidewalk will be
constructed.
c. At the north end of the project along North Bonnie Brae, an enhanced stane and
masonry wa11 will be constructed.
d. Within the 20-foot landscape buffer, medium canopy trees will be planted along the
street frontage at a rate of one- to three- inch caliper tree per each 45 linear feet.
These trees can be clustered or grouped with a minimum spacing of every 25 feet
on-center.
e. Areas between the 5-foot concrete sidewalk and back of curb will be planted with
salid Bermuda sod.
f. Areas between the 5-foat sidewalk and masonry wall may be planted with turf
grasses or other native grass as selected by owner. This area will be hydromulched.
g. Landscape beds may be utilized along the masonry wall.
10. Internal Open Space Landscaping (see the General Canceptual Site and Landscape
Plan)
a. Developer, location at his discretion, shall construct an all-weather trail
approximately 600 feet in length, through the selected internal open spaces. The
location shall be determined at time af final plans.
b. Developer shall lacate a minimum af five seating areas, adjacent to the concrete
sidewalk ar all weather trail. The seating areas shall consist of natural
boulders/rock sitting areas.
c. Developer shall construct a minimum of one shade structure averlooking the
existing lake. The shade structure shall be a minimum of 200 square feet
(10'x20') and shall include seating areas and a trash receptacle.
d. Developer shall install a dag waste station at a rate of one per 500 linear feet of
sidewalk. The waste station can be located closer than but not further than 500
linear feet spacing based on layout.
11. Parking
a. Single-family dwellings require 4 parking spaces. Tandem garage spaces within
the garage will not caunt toward minimum.
12. Signs
a. Subdivision monument signs must be constructed with masonry supparts.
b. Lighting must be shielded to prevent upward diffusion and glare onto surrounding
residential property.
13. Residential Building Regulations
a. Residential buildings shall utilize at least three (3) of the following design features
to provide visual relief along the front of the residence:
i. Dormers
ii. Gables
iii. Recessed entries, minimum of three (3) feet deep
iv. Covered front porches
v. Cupolas

b. Attached front entry garages of residential dwellings must be canstructed of wood,
