19-004WHEREAS, the City Council of the City of Denton previously authorized the City Manager, or his designee, to enter into an Interlocal Agreement ("Agreement") with the Texas Department of Public Safety (Ordinance No. 18-1449); and TownshipWHEREAS, an addendum has been added to the Agreement for inclusion of th4 of partnering agency; and the Agreement with this Addendum allows for local agencies specified under the Agreement, including the City of Denton, the City of Carrollton, and now, the Township of Little Elm, to enforce federal and state laws on uniform commercial vehicle weight within the Texas Transportation Code Chapter 621, Subchapter F; and WHEREAS, this Agreement and the Addendum will maximize uniform enforcement of the Texas Transportation Code Chapter 621, Subchapter F, through training, approved scale use, and consistency in annual scale recalibration standards, violation report requirements, and mandated annual reporting to the Texas Department of Public Safety; and WHEREAS, -s that the Addendum t• the Agreementb_ l served,interests for the safety of the citizens of the City of Denton, and that a valid government purposc. is as described herein; NOW, #' SECTION 1: The City Manager, or his designee, is hereby authorized to execute the Addendum to the Interlocal Cooperation Agreement on behalf of the City of Denton with the Texas Department of Public Safety, relating to the enforcement of state laws on uniform commercial vehicle weight enforcement with Texas Transportation Code Chapter 621, Subchapter F, which is attached hereto as Exhibit "A" and made a part hereof for all purposes. XF "S, MA "4�.�I ATTEST: JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM: AAR( LEAL, CITY AT'1,()I NEY' 7 ADDENDUM TO THE MUTUAL AID INTERLOCAL AGREEMENT FOR COMMERCIA1 VEHICLE ENFORCEMENT This Addendum to the Mutual Aid Interlocal Agreement For Commercial Vehicle Enforcement (the "Addendum"), to be effective as of the date of the last signature below, is hereby entered into by and between the Town of Little Elm and the current Members (cities of Carrollton, Denton, and Lewisville) of the Mutual Aid Interlocal Agreement For Commercial Vehicle Enforcement executed in 2013 ("Original Agreement") in order to provide for further cooperation among cities in the investigation and enforcement of federal and state laws and regulations intended to ensure the safe transportation of hazardous materials and the safe operation of commercial motor vehicles. The Original Agreement is hereby amended to include Little Elm as a Member, and the definition of Member in the Original Agreement is amended, restated, and replaced in its entirety and shall read as follows: ""Member" means any local governmental entity, including the City of Carrollton, Texas, the City of Lewisville, Texas, the City of Denton, Texas, and the Town of Little Elm, Texas (sometimes referred to collectively as "Members"), which is a party to this Agreement." 2. All other terms and conditions of the Original Agreement and any previous addenda are agreed to by all parties as of the signing of this Addendum by all parties. 3. This Addendum is hereby incorporated in its entirety into the Original Agreement.
