WHEREAS, On May 21, 2019, the Governor signed HB$52, passed by the required
supermajorities of both chambers of the Legislature in the 86t" regular sessian, so as to take
immediate effect; and
WHEREAS, this law effectively prohibits municipalities from basing residential building
permit fees on the value af the permitted structure, such that the ordinance setting the basis for
Denton's building permit fees must immediately be amended into compliance far this limited
purpase; and
WHEREAS, Denton expects to complete a comprehensive fee study for develapment
services and permitting priar to the end af the calendar year; and
WHEREAS, the proposed interim fee is designed to approximate the fees collected at a
similar level of cost recovery, without exceeding actual costs of services, pending campletion af
the comprehensive fee study and subsequent approval of the revised fee schedule; NOW
THEREFORE:

SECTION 1. The building permit fee far ane and two family dwel(ings is hereby amended
to a rate basis af $0.74 per square foot, The prior rate basis for this fee, based upon the value af
residential structures, is hereby superseded to the limited extent af this amendment, and all other
fees in the current fee schedule remain unchanged.
SECTION 2. The provisions of this ordinance are severable, and the invalidity of any
phrase or part of this ordinance shall not affect the validity or effectiveness of the remainder af
this ordinance.
SECTION 3. This ordinance shall become effective immediately upon its passage and
