SECTION 4. The provision of this Ordinance are severable, and the invalidity of any phrase or part of this Ordinance shall not affect the validity or effectiveness of the reminder of this Ordinance. SECTION 5. The City Secretary is hereby directed to record and publish the attached rules, regulations, and policies in the City's Code of Ordinances as authorized by Section 52.001 of the Texas Local Government Code. SECTION 6. It is hereby officially found and determined that the meeting at which this Ordinance was passed was open to the public, and that public notice of the time, place, and purpose of said meeting was given as required by the Open Meetings Act, Texas Government Code, Chapter 551. Notice was also provided as required by Chapter 52 of the Texas Local Government Code. SECTION 7. (b) This provision supersedes prior ordinances in con ict herewith, including but not li ited to Chapter 25 Article IV of the Cade of rdinances. ec. - . itt 1 re ire e ts The application for a Special Event Per it shall set forth, as a ini u, the following infor ation: (a} The na e, address, and telephone nu ber of: (1) the person seeking to conduct the Special Event; (2) if the Special Event is to be held for or by an organization: the org ization and the authorized agent of such organization; (3} if the Special Event is to be held by or for a person other than the applic t: the applic t shall file a itten state ent fro that other person showing authority to ake the application; d (4) the person who will be the event org izer and who will be responsible for conducting the event. (b) The propased location(s) for the Special Event. (c} The pu ose of the Special Event and type af activities held during the Special Event. (d) The date(s) d ti e(s) the Special Event will start and end. (e} The ti e at which on-site preparation for the Special Event will begin. (� The approxi ate nu ber of persons who are attending per day d for the duration of the Special Event, including the esti ated pe ti e, and approxi ate n ber of attendees during that peak ti e. (g) The nu ber and types of i als d vehicles that are part of the Special Event. (h} In the case of a Parade, the following additional infor ation shall be provided: (1) A route ap; (2) Approxi ate nu ber of p icipants in the P ade; (3) Type of p icip ts (ex. i als, oats, etc.}; and (4} hether the Parade will occupy all or only a portion of the width of the streets proposed to be traversed. (i) Proof of ins ce for the Special Event. (j) Site ap(s) showing site setup indicating equip ent that will be used by the Special Event, including the following additional info ation: (1) Location of first aid station and fire lanes for e ergency equip ent; � (2) Location d orientation of loudspeakers and any other noise a plification devices to be use by or at the Special Event, if any; (3) Location and size of tents, a ings, c opies, food service booths, or other te porary struct es; (4) etails for any pla ed signage; and (5} escription of arking and public tr sportation. (k) escription of the sale or consu ption of alcoholic beverages, if any. (1) Public safety plan. (o) Any other infor ation which the City shall fnd necess y under the standards for issu ce. Sec. 25-219. Standards for issuance of permit A Special Event shall be conducte in such a way that it: (a} ill not u ecess ily inte pt the safe and orderly ove ent of traffic near its location or route. (b) ill not require so great a nu ber of police officers to pro erly palice the S ecial Event that no al protection for the City is prevented. (c) ill not require so reat a nu ber of a bulances as to prevent nor al a bul ce service to portions of the City other than that to be occupied by the Special Event and adjacent eas. (d) ill not interfere with the ove ent of firefighting equip ent in route to a fire. The concentration of people, ani als, d vehicles at asse bly points will nat unduly interfere with proper fire d police protection ar a bul ce service to eas near such asse bly paints. (e) In the case of a arade, the parade shall be scheduled to ove fro its point of origin to its point of te ination without u easonable delays in route. ec. . e i r rev c ti (a) The irector of ks d ecreation, or his esignee, ay deny a Special Event Per it if: (1) The Special Event will con ict in ti e and location with another event for which a Special Event Per it has already been grante ; (2) The Applicant fails to co ply with, or the Special Event will violate, an ordinance of the City or y other applicable law; (3) The Applicant es or pe its the aking of a false or isleading state ent or o ission of aterial fact on an application for a Special Event Per it; . .. ; (4) The Applicant has been convicted of violating this Article or has had a Special Event e it revoked within the preceding twelve (12) onths; (5) The Applicant fails to provide proof of any license or per it required by this icle, City rdinance, or State law; (6) The Special Event, in the opinion of one or ore city dep ental directors, would severely hinder the delivery of nor al or e ergency services or constitutes a public t eat; (7) Insur ce require ents for the Special Event have not been et; or (8} The Applicant has, on prior occasions, da aged City property and has not pai in full for such d age. The objective standards used to dete ine the nu ber of E S perso el d a bulances shall be as follaws: (a) The esti ated nu ber of people who will attend; (b)The pe hourly attendance; (c) uration of the Special Event; (d} ether all or any portion of a roadway will be closed; (e)Uses adjacent to the pecial Event, such as residential ar co ercial areas; (f� Ti e an date of t e Special Event; ()Alcoholic beverages available for consu ption at the pecial Event; and (h)Need for safety zones (balloon/helicopter la ch or 1 ing ea, etc.). All reasona le alternative routes, ti es, and locations will be considered so as to offer the Applicant the option that will provi e the lowest costs consistent with the general ublic ealth, safety, d welf e. The cost or a ortion of the cost of providing E S perso el to eet these guidelines ay be requested by the Applicant and provi ed as in-kind services by the City upon approval fro City Co cil. ec. - . e The A plic t shall clean up i ediately after the canclusion of the Special Event. Sec. 25-243. Traf�c control plan Traffic control plans submitted as part of the Special Event application must be developed by a professional engineer or licensed traffic control professional in accordance with the Texas Manual on Uniform Traffic Control Devices. Sec. 25-244. In-Kind services The City may find that a Special Event is in the public interest and a benefit to the citizens, and therefore may grant in-kind services by waiving fees, including but not limited to, staff, facility rental fees, and security. Event organizers may submit a request to the City for in-kind services. If in-kind services are requested, City Council appraval is required, and a Special Event applicatian must be submitted ta the Director of Parks and Recreation, or his designee, at least ninety (90) days prior to the Special Event. Sec. 25-245. Nefghborhoad block parties The City believes that neighborhood block parties are in the public interest and a benefit ta the citizens. Persons organizing a neighborhood block party are required to obtain a Special Event Permit from the City and must file an application at least fourteen (14) days before the intended event date. The Director of Parks and Recreation, or his designee, may determine that the application can be processed in a shorter time period, taking into consideration the nature and scope of the proposed event. Neighborhood block parties will be exempt from Special Event applicatian fees described in this Article, but may be subject to other City fees (e.g. tent permit fees). A process for notifications to affected properties adjacent to the Special Event must be submitted in accordance with Sec. 25- 217. Neighborhood block parties are exempt from the insurance requirements set forth in Sec. 25- 248. Sec. 25-246. First Amendment activity Persons organizing a First Amendment Activity that is preplanned, scheduled, and promoted for a future date are required to obtain a Special Event Permit from the City and must iile an application at least seven (7) days before the intended event date. First Amendment Activities will be exempt from Special Event application fees and costs associated with policing the event. First Amendment Activities are exempt from the insurance requirements set forth in Sec. 25-248. DIVISION 4. PARADE Sec. 25-247. Public conduct (a) Interference. It shall be unlawful far any person to unreasonably hamper, obstruct, impede, or interfere with any Parade, parade assembly, or with any person, vehicle, or animal participating or used in a Parade authorized under this Article. (b) Driving through Parades. It shall be unlawful for any driver of a vehicle, bus, or bicycle to drive between the vehicles or persons comprising a Parade when such vehicles or persons are in motion and are conspicuously designated as a Parade. (c) Parking on a Parade route.
