WHEREAS, Texas Local Government Code, Chapter 395 authorizes a city to adopt and
amend impact fees far the purpose of financing capital improvements required by new
develapment; and
WHEREAS, the City Council of the City of Denton, Texas in accordance with state law,
initially enacted water and wastewater impact fees on September 15, 1998, with Ordinance Na.
98-301; and

WHEREAS, the City af Denton staff inadvertently failed to furnish the City of Krum with
a copy of the proposed land use assumptions, capital improvement plan, ar proposed Impact Fees
at least thirty days prior to any scheduled hearing therean, as speciiied within Section 23.7 of the
Wastewater Treatment Services Contract between the City of Dentan and the City of Krum; and
the City of Denton sent a notiiicatian letter dated February 22, 2019 to the City of Krum to inform
the City of the amendment of the Water and Wastewater impact fees, said letter establishing the
effective date of the new wastewater impact fees to be paid by the City of Krum to the City of
Denton of April 15, 2019 ("February 22 Notificatian Letter"}; and

WHEREAS, the City of Krum requested the City of Denton to apply the prior wastewater
impact prior impact fee of $2,200 per Single Family Equivalent to Hopkins Meadows Phase 2,
representing approximately 76 lots, said action to be accomplished by changing the effective date
of the new impact fee of April 15, 2019 as outlined in the February 22 Notification Letter, to a
date past the final plat approval date of Hopkins Meadows Phase 2, said date being estimated to
be July 15, 2019; and
WHEREAS, Denton's rescission of the February 22 Notification Letter establishing the
effective date of the amended wastewater impact fee, along with Krum's acknowledgement and
acceptance of both the updated wastewater impact fee study and the amended wastewater impact
fee, will allow the Denton and Krum to comply with the terms and conditions of both Ordinance
No. 2002-104 and Ordinance No. 19-008 while allowing Denton to deliver a new notification letter
establishing the effective date of the amended wastewater impact fee to a date on July 15, 2019;
and
WHEREAS, the City Council finds that this resolution is in the best interest of the citizens
and ratepayers of the City of Denton; and
THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES:
SECTION 1,, The facts, circumstances, recitations, and findings contained in the preambles
to this Resolution are found and declared to be true and correct.
SECTION 2. The February 22 Notification Letter is rescinded and of no further force and
effect and as such the effective date of the amended wastewater impact fee of April 15, 2019 is
also rescinded and of no further force and effect.
SECTION 3, Staff is directed to deliver a new notification letter establishing the effective
date of the amended wastewater impact fee to a date on July 15, 2019.
SECTION 4. This Resolution shall become effective immediately upon the date of its
passage.
