WHI=aRT;AS, it is in the City's interest to improve pedestrian and bicycle safety in the Fry
Straet business area, and
HF., EAS, contemporaneous to this ordinance, the City is also passing an ordinance to
limit parking on Che south side of West Hickory Street fram �lvenue S to Welch Streets, and
parking can be relocated ta Avenue A and u[berry Streets; and
WHrREnS, the ilniversity of North Texas is supportive of this trafiic pattern change
whieh abuts their praperty; and
HE E�1S, on April 9, 2019, the Mability committce endorsed the traffic pattern
conversion of Ave A(from I-Iickary to Mufberry} and Mulberry Street (from Avenue A to Welch
Street} to one-way traffic; anc�
WHF_, EAS, the Traftic Saiety Commiss►an i•eviewed and endo'°sed this proposal on
P'ehruary 4, 2019; NOW Ti-iI;RT?rORT:
THE COIJNCIL OI' THE CI'TY OF DENTON 1-ILRE:I3Y ORDAINS;
SECTION 1; The recitations in the preamble oi'the ordinance are incorporated herein by
ref`erence.
STCTION 2: When signs anci/or marking a'• any co bination thereof are in place giving
notice thereof, traPlic tlow shall be converted to north-baund only on Avenue A from Mulberry
Street ta West Hickory 5treet, and traf�ic ilow shall be convei°ted ta west-baund only on ulberry
Street from Welch Street to Avenue A.
SECTION 3, 'I'he provisions af Section 2 converting traffic flow from two-way to one-
way shall apply on the designatcd portion of thc above-namcd streets, except when modified by
an approved traffic control plan, ar in campliance with the direction of a palice ofiicer or officiai
traffic control device.
SECTION 4: �ll provisions of Che ordinances ai' the City of Denton in conflict with the
provisions of this ordinance as related to the abave traffic tlow are hereby repealed, and all other
provisions of the ordinances oi' the City of Denton not in conflict with the provisions of this
ordinance, shall remain in full force �nd effect.

SI;C"fION 5: If any section, subsection, paragraph, sentence, clause, phrase, or word in
this ordinanee, or application thereoP to any person or circumstances is held invalid by any court
of competent jurisdiction, such holding shall not ailect the validity ol'the cemaining portions o1�
this ordinance, and the City Council oi'the City o1' Denton, Texas hereby declares it would have
enacted such remaining portions despite any invalidity,
SECTION 6; Savc and except as amended hereby, all the provisions, sections, subsections,
parabraphs, sentences, clauses, and phrases oi'the Code of Ordinances shall remain in full force
and eli'ect.
S�CTION 7: Any person iound liable oi'violatin�; this Ordinance by a court of competent
jurisdiction shall be fined a sum not to exceed five hundred dollars ($500). Each day that a
provision of this ordinance is violated shall constitute a separate offense, '1'he disposition of
parkin� citations issucd pursuant to this Ordinance shall be governed by Uivision 3 titled "Parking
Violations Division" of Chapter 18 of the Code ol' Ordinanees.
SCCTION 8; This Ordinance, providin� for a penalty, shall become effective 14 days from
the date of its passage and shall be implemented when all appropriate signage and traffic control
devices are in place, and the City Secretary is hereby directed to cause the caption of this
ardinances to be published twice in the Denlon Izecvrd-Chronicle, the official newspaper in the
City of Denton, Texas, within 10 days of the date of its passage.
