WFIERI;AS, on December 14, 2O18, a City o!� I)enton employce caused extensive
damage to a 2017 Komalsu hydraulic excavator ("Properly"} rented f'rom Kirby-Smith
Machinecy, Inc, (the "Cantractor"}; and
WHI�RLnS, the City received payment in thc arnount of $114,759.76 pursuant to a
statement oi' settlement ai' loss frot�n its property insurance policy with �lffiliated FM Insurance
Company f'or dama�e to ihe ['roperty; and
WHF.,REAS, the Contractar and the City have agrecd to settle all claims for payment in
the amount of` $123,750.00, in return for the Contractor releasing all claims related to this
incident and the Property; and
WIiI;RC/�S, the City Council deems it in the public interest tn approve the settlement of

Uamage Claims by the Cantractor, the City hereby authorizes the expenditure of $123,750.00 to
the Contractar in settlement of Contractor's claims for dama�e to the Yraperty. 'fhe City hereby
accepts and approves the Release in l�ull of �111 Property Uama�e Claims executed by the
Contraetor and the City Manager, or his designee, is hereby authorized to make the authorized
payment to the Contractor and execute any other documenls and lorm approved by the City
Attorney, arising out o('the incident that caused the damage. to lhe Praperty.
