ZCI19-0009c�S.1L�Lg�I\�1ur C3ocuraacntslC7r�irnancesll �71'LCI C 9-0009 docx •' � ' ' # • ��+��i AN ORDINANCE OF THE CITY OF DENTON, TEXAS, CHANGING THE ZONING DISTRICT AND USE CLASSIFICATION FROM REGIONAL CENTER RESIDENTIAL 1 (RCR-1) AND REGIONAL CENTER COMMERCIAL DOWNTOWN (RCGD) TO THE SUBURBAN CORRIDOR (SC) ZONING DISTRICT AND USE CLASSIFICATION DEFINED UNDER THC 2019 DENTON DEVELOPMENT CODE (ORDINANCE DCA]$-0009Q), ON APPROXIMATELY 25.31 ACRES OF LAND, GENERALLY LOCATED WEST OF SAN JACINTO BOULEVARD AND NORTH OF I-35E, [N THE CITY OF DENTON, DENTON COUNTY, TEXAS; AMENDING THE CITY'S OFFICIAL ZONING MAP; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VfOLATfONS THEREOF; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. (ZCI19- 0009) WHEREAS, tl�e City of Denton is initiating a change in the zaning district and use classificatian fram Regianal Center Residential 1(RCR-1) and Regional Center Commercial Dawntown (RCC-D) to the Suburban Corridar (SC) zoning district and use classiiication defined under the 2019 Denton Development Code (Ordinance DCA I 8-0009q) on approximately 25.31 acres of land legally described in Exhibit "A" and generally depicted in the map in Exhibit "B," both af which are attached hereto and incorporated herein by reference (hereinafter, "the Praperty"); and WHEREAS, on June 26, 2019, the Planning and Zaning Commissian, in compliance with the laws of the State of Texas, after giving the requisite notices by publication and otherwise, and after holding due full and fair hearings and to all property owners interested in th►s regard, has recammended approval [7-0] of the change in the zoning district and use classification; and WHEREAS, on July 23, 2019, the City Council likewise conducted a public hearing as required by law, and upon consideration, the City Council hereby finds that the request is consistent with the Denton Plan, the 2019 Denton Development Code (Ordinance DCA 1$-0009q}, and federal, state, and local law; and WHEREAS, the Planning and Zoning Commissian and the City Cauncil, in considering the change in the zoning district and use classification, have determined that the proposed change is in the best interest of the health, safety, marals, and general welfare of the City of Denton and its citizens; and WHCREAS, the City Council of the City af Denton finds that the change in the zaning district and use classification should be granted as set farth herein; NOW THEREFORE, THE COUNCIL OF THC CITY OF DCNTON HEREBY ORDAINS: �1;�� 1 N�:�� 1�, The findings and recitations contained in the preamble of this ardinance are incarporated herein by reference and found to be true. �aM��( l�f��� "�,?. The zoning district and use classification for the Property is hereby changed fram Regional Center Residential 1(RCR-1) and Regional Center Commercial Downtown (RCC- D) to the Suburban Corridar (SC) zoning district and use classification defined by the 2019 Denton Development Code (Ordinance DCA 1$-0009q). �„1 � I�;�")� r�. The City's official zaning map is hereby amended to show the zoning district and use classification. ��,(:"'I"I��1"�J ��, Any persan, firm, entity or corporation violating any provision af this ordinance shall, upon conviction, be fned a sum not exceeding $2,000.00 for each violatian. Each day that a provision of this ordinance is violated shall canstitute a separate and distinct offense. The penal pravisions imposed under this Ordinance shall not preclude Denton from filing suit to enjoin the violatian and it retains all legal rights and remedies available to it under local, state and federal law. �;) �""1"��.:?�!m�� lf any provision of this ardinance or the application thereof to any person ar circumstance is held invalid by any court, such invalidity shall affect the validity of the pravisions ar applicatians, and ta this end the provisians of this ordinance are severable. SECTION 6.
