AN ORDINANCE OF THE CITY OF DCNTON, TEXAS, CHANGING THE ZONING
DISTRICT AND USE CLASSIFICATION FROM REGIONAL CENTER COMMERC[AL
NEIGHBORHOOD (RCC-N) AND REGIONAL CENTER COMMERCIAL DOWNTOWN
(RCC-D) TO THE HIGHWAY CORRIDOR (HC) ZONING DISTRICT AND USE
CLASSITICATION DEFINED UNDER THE 2019 DENTON DEVELOPMENT CODE
(ORDINANCE DCA18-0009Q), ON APPROXIMATELY 87.62 ACRES OF LAND,
GENERALLY LOCATED WEST OF 1-35 BETWEEN LOOP 288 AND US 380, IN THE CITY
OF DENTON, DENTON COUNTY, TEXAS; AMCNDING THE CITY'S OFFICCAL ZONING
MAP; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR
VIOLATIONS THEREOF; PROVIDING FOR SEVERAIiILITY; AND ESTABLISHING AN
ErFECT[VE DATE. (ZCI19-0028}
WHERCAS, the City of Denton is initiating a change in the zoning district and use
classification from Regianal Center Cammercial Neighborhaod (RCGN} and Regional Center
Commercial Downtown (RCC-D} ta the Highway Corridar (HC) zaning district and use
classificatian defined under the 2019 Denton Develapment Code (Ordinance DCA 1$-0009q) an
approximately $7.62 acres of land legally described in Exhibit "A" and generally depicted in the
enap in Exhibit "," bath of which are attached hereta and incorporated herein by reference
(hereinafter, "the Property"}; and
WH�REAS, on June 26, 2019, the Planning and Zoning Commission, in compliance with
the laws of the State af Texas, after giving the requisite notices by publication and atherwise, and
after halding due full and fair hearings and ta all praperty owners interested in this regard, has
recommended approval 7-0 of the change in the zoning district and use classification; and
WHCREAS, on July 23, 2019, the City Cauncil likewise conducted a pubfic hearing as
required by law, and upan cansideration, the City Council hereby finds that the request is
consistent with the Dentan Plan, the 20l 9 Denton Development Cade (Ordinance DCA l$-0009q),
and federal, state, and local law; and
WHEREAS, the Planning and Zoning Commission and the City Cauncil, in considering
the change in the zoning district and use classification, have determined that the proposed change
is in the best interest of the health, safety, morals, and general welfare of the City af Denton and
its citizens; and
WHEREhS, the City Council of the City af Denton finds that the change in the zaning
district and use classificatian should be granted as set farth herein; NOW THEREFORE,
THE COUNCIL OF Tl-fE CITY OF DENTON HEREBY ORDAINS:
S,ECTION 1. The �ndings and recitations contained in the preamble of this ardinance are
incorporated herein by reference and faund ta be true.

and use classification.
SECTION 4. Any person, firm, entity or corporation violating any provision of this
ardinance shall, upan conviction, be �ned a sum not exceeding $2,000.00 for each violation. Each
day that a provision of this ordinance is violated shall constitute a separate and distinct offense.
The penal provisions impased under this Ordinance shall not preclude Denton from filing suit ta
enjoin the violation and it retains all legal rights and remedies available to it under local, state and
federal law.

circumstance is held invalid by any caurt, such invalidity shall affectthe validity ofthe provisions
or applications, and to this end the provisions af this ardinance are severable.
SECTION 6. That an offense committed before the effective date of this ordinance is

when the offense was committed, and the former law is cantinued in effect for this purpose.

passage, and the City Secretary is hereby directed ta cause the caption of this ordinance to be
published twice in the Dentan Recard-Chranicle, a daily newspaper published in the City of
Denton, Texas, within ten (10) days of the date af its passage.
