AN ORDINANCE OF THE CITY OF DENTON GRANTING THE DENTON BLACK
CHAMBER OF COMMERCE A NOISE EXCEPTION PURSUANT TO SECTION 17-20 OF
THE CITY OF DENTON CODE OF ORDINANCES, WITH RESPECT TO SOUND LEVEL5
AND HOURS OF OPERATION FOR THE DENTON BLUES FESTIVAL, WHICH WILL BE
HELD ON FRIDAY, SEPTEMBER 20, 2019 FROM 11:00 A.M. TO 11;00 P.M., SATURDAY,
SEPTEMBER 21, 2019 FROM 12:00 P.M. TO 11:00 P,M., AND SUNDAY, SEPTEMBER 22,
2019 FROM 10:00 A.M. TO 10:00 P.M., AT THE QUAKERTOWN PARK; G NTING AN
INCREASE IN SOUND LEVEL5 AND A VARIANCE IN THE HOURS OF OPERATION ON
SAID DATES FOR FRIDAY FROM 11:00 A.M. TO 11.00 P.M., SATURDAY FROM 12:00
P.M. TO 11:00 P.M., AND SUNDAY FROM 10:00 A.M. TO 10:00 P.M., VJITH SOUND NOT
TO EXCEED 70 DECIBELS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to Section 17-20 af the Code of Ordinances of the City of Denton, the
City Council may make exceptions upon application for sound levels or hours af operation when
the public interest will be served thereby; and
WHEREAS, The Denton Blacic Chamber of Commerce has made an application to the City
Council for an exception to the provision of Section 17-20 of the Code of Ordinances regarding
sound levels and hours of operatian, in connection with Blues Festival annual event held at
Quakertown Park, with said request being far the following dates: September 20 — 22, 2019; and

THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. Pursuant to Section 17-20 of the Code of Ordinances, Denton Black Chamber

7. This Ordinance shall be strictly canstrued as an exception granted pursuant to Section 17-
20 of the Code of Ordinances of the City of Denton. The City of Denton expressly reserves
unto it��lf and all other persons any ������� ���ll legal remedi����, both civil ;�v��� crim������, relating
to ex� a���^�ive noise in correction w��1�1��� this annual �.��*nt, and h� ���:��y di�����a�ms any
promissory, or equitable estoppel which might in any way impede the pursuit of such
remedies by any person.
5�:�;��""��`i�ON 2. This Ordinance shall be effective immediately upon its passage and
approval and shal
1 expire upon the completion of the Denton Blues Festival on Sunday,
September 22, 2019, unless soaner repealed, modiiied, or rescinded.
