AN ORDINANCE OF THE CITY OF DENTON, A TEXAS MUNICIPAL HOME-RULE
CORPORATION, REIMBURSING LGI HOMES, 1NC., A DELAWARE CORPORATION,
$236,000 AS A CREDIT FOR ASSESSED AND COLLECTED ROADWAY IMPACT FEES
FOR BEAVER CREEK ADDITION - PHASE 1 B AND BEAVER CREEK ADDITION - PHASE
2, DENTON, DENTON COUNTY, TEXAS, PURSUANT TO ORDINANCE 2016-189;
PROVIDING FOR THE EXPENDITURE OF FUNDS; AND, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on June 21, 2016, the City of Denton, a Texas municipal home-rule
corporation ("City"), adopted a roadway impact fees ordinance (Ordinance No. 2016-189);
WHEREAS, in 2018, LGI Homes, Inc., a Delaware corporation ("LGI"), was assessed,
and has paid, roadway impact fees for each of the 95 lots of Phase 1B - Beaver Creek, Denton,
Denton County, Texas, with said fees for Phase 1 B totaling $190,000;
WHEREAS, in 2018, LGI was assessed, and has paid, roadway impact fees for each of the
23 lots of Phase 2- Beaver Creek Addition, Denton, Denton County, Texas, with said fees for
Phase 2 totaling $46,000;
WHEREAS, on June 26, 2019, LGI requested that it be reimbursed as a credit against the
previously assessed and paid roadway impact fees of $236,000;
WHEREAS, LGI, at its cost, constructed roadway infrastructure adjacent to Phases 1B and
2, Beaver Creek, in excess of what was required of it under Ordinance No. 2016-189 and is allowed
a credit for the previously assessed and paid roadway impact fees of $236,000;
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The recitations contained in the preamble of this Ordinance are considered
as findings and incorporated herein by reference.
SECTION 2. The City Manager or his designee is authorized to pay the amount of
$236,000 to LGI Homes, Inc., from the City's Roadway Impact Fee Fund.
SECTION 3. This ordinance shall become effective immediately upon its passage and
approval. �
