(DCA19-0013} WI-IEREAS, pursuant to Ordinance No. DCA18-0009q, the City Council of the City of Denton, Texas adopted the newly revised Denton Development Code (the "DDC"); and WHEREAS, Ordinance No. DCA l$-0009u adopted a city-wide rezoning in accordance with the newly adopted zoning districts of the new DDC, but expressiy provided in Section 2, Paragraph 2, that properttes previously designated under prior development codes as Master Planned Communities ("MPCs") shall retain the zoning and development regulations established by their respective MPC ardinances, specifically including those regulations incorporated {ar excepted) fram prior developsnent codes or ordinances as they existed on the date of approvai for each MPC appraval ord►nance and amendment; and WHCREAS, the City desires to amend Subchapter 1 General Standards of the DDC in arder to create Subsection 1.7.9 ta codify Section 2, Paragraph 2 of Ordinance No. DCA 18-0009u into the new DDC, in order to reference the ordinances and regulations that apply to them; and WHERCA5, on October 16, 2019, the Planning and Zoning Cammission, in complianee with the laws ofi the State of Texas, gave the requisite notices by publication, held due hearings and recommended approval [6-0] of these amendments to the DDC; and WHEREAS, on Navember 5, 2019, the City Council likewise conducted a public hearing in accardance with local and state law and the City Council hereby finds that the subject amendments to Subchapter 1 a�•e consistent with the City's comprehensive plan, and federal, state, and local law are in best interests of the citizens of the City of Denton; NOW, THEREFORE, THC COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: ,�l �"I`I��� I_ 'The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference and found to be true. 2. The amendments to Denton Development Code Subchapter 1, as presented SECTIONm_�_ herein, are hereby adopted as shown below: 1.7.9 Master 1'lanned Communities The following Master Planned Communities (MPCs) shall retain the zoning and development regulations established by their respective MPC ordinances, specificaliy including those regulations incorporated (or excepted} from prior development codes or ordinances as they existed on the date af approval for each MPC approval ordinance and amendment. A. Hills of� Denton MPC (Ordinance 2007-150), B. Cole Ranch MPC (Ocdinance 2008-030). C. Hills of Denton North MPC (Ordinance 2008-262)� D. Hunter Ranch MPC (Ocdinances 2008-286; 2010-159; and 2010-160), SECTION 3. Any person, Crm, parinership or corporation violating any provision of this ordinance shall, upon conviction, be deemed guilty of a misdemeanor and shall be punished by fine in a sum not exceeding $2,000.00 for each offense. Each day that a provision of this ordinance is violated shall constitute a sepacate and distinct offense. SECTION 4. ]f any provision of tllis ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of tlle provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 5. That an offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Denton Code of Ordinances, as amended, in effect wllen the offense was coinmitted and the former law is continued in effect for this purpose. SECTION 6. In compliance with Section 2.09(c) of the Denton Charter, this ordinance shall become effective fourteen (l4) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record- Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage.
