DCA19-0023bDCA 19-0023b DDC Amendment Subchapter 5-Nunc Pro Tunc Ordinance oxDnvaNCE No. DCA19-0023b AN ORDINANCE OF THE CITY OF DENTON, TEXAS, NUNC PRO TUNC, CORRECTING AN INADVERTANT MISTAKE IN ORDINANCE NO. DCA 19-0023a RELATING TO MD AND SC ZONING DISTRICTS; PROVIDING A SAVINGS CLAUSE AND AN EFFECTIVE DATE. (DCA19-0023b) WHEREAS, pursuant to Ordinance No. DCA18-0009q, the City Council of the City of Denton, Texas, adopted the newly revised 2019 Denton Development Code, the ("DDC"); and WHEREAS, on January 7, 2020, the City Council approved Ordinance No. DCA19-0023a relating to Subchapter 5"Use Regulations " of the DDC to revise the Table of Allowed Uses to permit Administrative, Professional, and Government Office and Medical Office uses within the Residential7 (R7) zoning district with use-specific standards; and WHEREAS, City Staff discovered an inadvertent mistake in the square footage of inedical uses in the MD and SC zoning districts in item 3 of Section 3 of Ordinance No. DCA19-0023a, which resulted in an ordinance that did not accurately reflect what the City Council intended to approv�� and WHEREAS, City Staff requests that the inadvertent mistake be revised to correctly reflect the intention of the City Council in Ordinance No. DCA19-0023a, as stated in Exhibit A; and WHEREAS, the City Council has the inherent power to retroactively correct such mistakes to accurately reflect is official actions; and WHEREAS, the City Council finds that said corrections are in the best interest of the citizens of the City of Denton and should be adopted as stated herein; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference and found to be true. SECTION 2. The current text in Section 3 of Ordinance No. DCA19-0023a is hereby amended to the limited extent necessary to correct a clerical mistake and accurately reflect the correct square footage in the MD and SC Zoning Districts as follows: 1. R7 Zoning District Uses greater than 10,000 square feet requires a specific use permit pursuant to Subsection 2.5.2: Specific Use Pennit (SUP). 2. MN Zoning District Uses are limited to no more than 10,000 square feet of gross floor area per lot. Page 1 of 3 DCA 19-0023b DDC Amendment Subchapter 5- Nunc Pro Tunc Ordinance 3. MD and SC Zoning Districts Medical Office uses with more than 25,000 square feet per lot shall require a specific use permit pursuant to Subsection 2.5.2: Specific Use Permit (SUP). SECTION 3. All other provisions of Ordinance N�.>. DCA19-0023a not specifically amended or deleted herein shall continue in full force and effect from the date of original passage on January 7, 2020. SECTION 4. This Ordinance shall become effective immediately upon its passage and approval.
