DATE. W1 �EREAS, the City Council of the City of Denton creates various boards, eommissi�ns, and committees to participate in the City's �overnmental process, and gi�°c� input on topics of commuility impot-tance; and WHF,REAS, the City Council recognizes that board, commission, and committee membership is a si�nificant time cotnmitment for Denton residents; and WHEREAS, the City Council desires to help membeis of boards, commissions, and committees better understand the time cammitment and meeting schedule �f their respective seat by cequiring the adoption of regular meeting schedules annually; and WHEREAS, Denton City Council meetings are conducted in accordance with the Co�ancil Rules of Procedure set forth in Sectio» 2-29 of the Denton City Code of Ordinances; NOW TH�REFORE, THE COUNCIL OF THE CI"T'Y OF DENTON HER�BY ORDAINS: SECTION 1. That Sec�lon 2-29 (h) of tl�e ne►�ton Code of Ordinances, known as the Dcnton City Council Rules of Procedure, is herel�y amended to read as follows: (h) C��enlion �fconamil/ees, boards and cvmrriissions. (1) C.�O1.lYtCll c��mmiltees: �The council may, by t�esolution and as the need arises, authorize thc appointment oi'council committees. Any committee so ceeated shall cease to exist when abalis}ied by resolution of the council. Council committees shall comply with Tl�e Texas �pen Meetings Act. (2) CllJzert bocrr•c�s, con�rnissiovrs, anc� cnn�mit�ee.s�: The council may cr•eate other citizen boards, commissions, and committees to assist in the conduct of the operation of the city goverl�rnent wiTh such duties as the council may specify not inconsistent with the City Gharter or Code. Creatic�t� of such boards, commissions, and committees and me�nberships and selection oi' members sl�all be by council resolution if' not otherwise speciiied by the City Charter or Code, Any board, cornmission, or committee so ereated shall cease to exist when abolished by a resolution approved by the council. No committee so app�inted shall have powers other than advisory to the council or to the city manager, except as otherwise specified by the Charter or Code. Ail citizen boards, commissions, and committees shall camply with the procedural requirements of the Texas Open Meetings Act. Any reference in this article to "citizen boards, commissions, and cotalanittees" includes citizen task iarces and citizen ad hoc boards, cammissions, and cc�mmittees unless otherwise indicated herein. (3) Ap�oin�mer��.s: a. Individual city council members making nominations for members to citizen boards, commissions, and con�mittees will consider interested persons on a citywide basis. b. The city council will make an eff'ort to be inclusive of all segments of the com�nunity in the board, commission, and committee appointment process. City council me���bei•s will consider ethnicity, gender, socia-economic ievels, and other factors to ensure a diverse representation of De»ton citizens. c. The city council will take into c�nsideration an individual's qualitications, willin�ness to serve, and application information in selecting nominations for membership to each board, commission, and committee. d. In an effort to ei�sure n�a�imum citizen pai�ticipation, city council members will continue the general practice of nominating new citizens to replace board members who have seived three (3) consecutive terms on the �ame hoard per the provisions of Denton Cade of Ordinances, section 2-65. "1'his provision daes not apply to citizen task forces and citizen ad hoc committees. e. Each city council member wili be responsible for making nominations far board, committee, and comrnission places assigned to him or her, which shall correspond to the city council member's place. Individual city council members tvill make nominations to the full city council for the governing body's approval or disapproval. (4) R�.tles of pr�ocedttre: a. All board, commission, and cammittee members, including citizen bo�ar�, commission, and cornmittee n�embers, shall comply with the provisions of articte II of chapter 2 of the Code of Ordinances. All board, co�nmission and committee members, including citizen board, commission, and committee members, shall be �rovided a copy of these rules of`�rocedure and a copy of tlle City of Denton Handbook for Boards, Commissions and Comiiiittees, which shall govern operational procedures of all boards, commissions and committees, including citizen boards, comrnissions, and committees. All boards, commissions, and cammitTees, including citizen boards, coinenissions and cammittees, shall comply with these rules as to the }�reparation oi�minutes of ineetings, and such minutes shall be prepared in accc�rdance with the pnlicies and procedures of the city secretary. b. f1ll citizen board, conlmission, and eommittee members shall comply with the procedural requirements uf'the V.T.C.A., Texas Government Code Chapter 551, also known as the "Texas Open Meetings Act" as they appear now or may be amended in the future. Notice of all meetings shall be posted in co�npliance with the Texas Opcn Mectings Act and minutes and records will be maintained in accordance with requirements of the city secretary's office. �ach citizen board, comrnission, and committee memher shall be provided a copy of the Texas Open Meetin�;s Act. Penalty provisions of the Texas Open Meetings Act sllall only apply ta citizen boards, commissions, and cornmittees with rule making or c�uasi- judicial powe�•, as set forth in thc Texas Open Meetings tict and as interpreted by Texas Courts. c. Unless otherwise provided by law, each board, comrnission, or committee, shall adopt a regular meetin� scl�edule by no later than the body's tirst meetin�; of the calendaj• year. All rcgular meeting schedules shall be sent to the City Secretary's 011ice lor olticial record ke��i��� pu�poses upon adoption. Regular meetin� schedules should include all planned meetings the body intends to have during the calendar year. S�CTION 2. The provisions of this Ordinance are severable, and the invalidity of any phrase, clause, or part of the Ordinance shall not affect the validity or effectiveness of the rernainder of the Ordinance. SECTION 3. This ordinance shall become effective immediately upon its passage and approval.
