AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING AN OVERLAY
DISTRICT AND APPROVING AN AMENDMENT TO THE FIRST UNITED METHODIST
CHURCH SPECIAL SIGN DISTRICT FOR 4.141 ACRES OF LAND WHICH IS LOCATED
AT 201 S. LOCUST STREET AND PLATTED AS LOT 1R, BLOCK 23, ORIGINAL TOWN
OF DENTON ADDITION, IN THE CITY OF DENTON, DENTON COUNTY, TEXAS;
PROVIDING FOR A PENALTY 1N THE MAXIMUM AMOUNT OF $ 2, 000.00 FOR
VIOLATIONS THEREOF; PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE
DATE. (SD 19- 0001)
WHEREAS, Alan Heath, on behalf of First United Methodist Church of Denton, Inc., has
app��cc� for an amendment to the First United Methodist Church Special Sign District (Ordinance
Number 2010-016 and amended by Ordinance Number 2012-317) on real property land legally
described as Lot 1 R, Block 23, Original Town of Denton Addition (hereinafter defined as the
"Property"); and
WHEREAS, on December 11, 2019, the Planning and Zoning Commission, in compliance
with the laws of the State of Texas, have given the requisite notices by publication and otherwise,
and have held due hearings and afforded full and fair hearings to all property owners interested in
this regard, and recommended approval [7 — 0] of the amendment to the Special Sign District; and
WHEREAS, on February 4, 2020, the City Council likewise conducted a public hearing as
required by law, and finds that the request meets and complies with all substantive and procedural
standards set forth in the Denton Development Code, and is consistent with the 2030 Denton Plan;
NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference.
SECTION 2. The Special Sign District amendment is hereby approved on the Property
subject to the following conditions:
�. Any provision of the sign code not addressed by the Special Sign District shall be
governed by Chapter 33, the Sign Code.
SECTION 3. All provisions of Ordinance Number 2010-016, as amended, shall remain in
full force and effect.
SECTION 4. If any �rovision of this ordinance or the application thereof to any person or
circumstance is held invalid by any court, such invalidity shall not affect the validity of other
provisions or applications, and to this end the provisions of this ordinance are severable.
SECTION 5. Any person violating any provision of this ordinance shall, upon conviction,
be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense.
SECTION 6. In compliance with Section 2.09(c) of the Denton Charter, this ordinance
shall become effective fourteen (14) days from the date of its passage, and the City Secretary is
hereby directed to cause the caption of this ordinance to be published twice i� the Denton Record-
Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the
date of its passage.
