AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT
WITH XYLEM WATER SOLUTIONS U.S.A., INC., FOR THE PURCHASE OF
EQUIPMENT, MATERIALS AND PARTS FOR THE OPERATION AND MAINTENANCE
OF THE ULTRAVIOLET DISINFECTION SYSTEM AT THE WASTEWATER
TREATMENT PLANTS; PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR;
AND PROVIDING AN EFFECTIVE DATE (IFB 7299 — AWARDED TO XYLEM WATER
SOLUTIONS U.S.A., IlVC., IN THE FIVE (5) YEAR NOT-TO-EXCEED AMOUNT OF
$550,000).
WHEREAS, the City has solicited, received, and tabulated competitive bids for the
purchase of necessary materials, equipment, supplies or services in accordance with the
procedures of State law and City ordinances; and
WHEREAS, the City Manager, or a designated employee, has reviewed and
recommended that the herein described bids are the lowest responsible bids for the materials,
equipment, supplies or services as shown in the "Bid Proposals" submitted therefore; and
WHEREAS, the City Council has provided in the City Budget for the appropriation of
funds ta be used for the purchase of the materials, equipment, supplies, or services approved and
accepted herein; NOW, TI-�REFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION l. The following competitive bids for the materials, equipment, supplies, or
services, as described in the "Bid Invitations", "Bid Proposals" or plans and specifications on file
in the Off'ice of the City's Purchasing Agent filed according to the bid number assigned hereto,
are hereby accepted and approved as being the lowest responsible bids:

SECTION 2. The acceptance and approval of the above competitive bids shall not
constitute a contract between the City and the person submitting the bid for such items and
agrees to purchase the materials, equipment, supplies or services in accordance with the terms,
specifications, standards, quantities and for the specified sums contained in the Bid Invitations,
Bid Praposals, and related documents.
SECTION 3. Should the City and the winning bidder(s) wish to enter into a formal
written agreement as a result of the acceptance, approval, and awaxding of the bids, the City
Manager, or his designated representative, is hereby authorized to execute a written contract in
accordance with the terms, conditions, specifications, standaxds, quantities and specified sums
contained in the Bid Proposal and related documents and to e�tend that contract as determined to
be advantageaus to the City of Denton.
SECTION 4. The City Council of the City of Denton, hereby expressly delegates the
authority to take any actions that may be required or permitted to be performed by the City of
Denton under this ordinance to the City Manager of the City of Denton, or his designee.
SECTION 5. By the acceptance and approval of the above enumerated bids, the City
Council hereby authorizes the expenditure of funds therefor in the amount and in accordance
with the approved bids.
SECTION 6. This ordinance shall become effective immediately upon its passage and
approval.
