AN ORDINANCE OF THE CIT� OF DENTON, A TEXAS HOME-RULE MIJNICIl'AL
CORPORATION, AUTHORIZING THE APPROVAL OF A FIRST AMENDMENT TO A
PROFES SIONAL SERVICE AGREEMENT BETWEEN TI-� CITY OF DENTON AND FREESE
& 1VICHOLS, INC., AMENDING THE CONTRACT APPROVED BY CITY COUNCIL ON 7ULY
16, 2019, IN THE NOT-TO-EXCEED AMOUNT OF $106,750; SAID FIRST AMENDMENT TO
PROVIDE PREPARATIONS OF AN EMERGENCY RESPONSE PLAN IN COMPLIANCE WITH
TI-� AMERICA' S WATER INFRASTRUCTURE ACT (AVVIA) OF 2018; PROVIDING FOR TI�
EXPENDITURE OF FUNDS THEREFORE: AND AN EFFECTIVE DATE (FILE 6590-061 —
PROVIDING FOR AN ADDITIONAL FIRST AMENDMENT EXPENDITURE AMOUNT NOT-
TO-EXCEED $76,000, WITH THE TOTAL CONTRACT AMOUNT NOT-TO-EXCEED
$182,750).
WHEREAS, on July 16, 2019, the City Council awarded a contract to Freese & Nichols, Inc.,
in the amount of $106,750 to perform risk and resiliency assessment to comply with the America
Water Infrastructure Act (AWIA) of 2018; and
WHEREAS, the Staff having recommended, and the City Manager having recommended to
the Council that an amendment be authorized to amend such contract agreement with respect to the
term of the agreement and an increase in the payment amount; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The First Amendment, increasing the amount of the contract between the City
and Freese & Nichols, Inc., which is on file in the office of the Purchasing Agent, in the amount of
Seventy-Six Thousand and 0/100 ($76,000} Dollars, is hereby approved and the expenditure offunds
therefor is hereby authorized in accordance with said amendment. The total contract amount increases
to $182,75Q.
SECTION 2. This ordinance sha11 become effective immediately upon its passage and
approval.
