AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZING THE APPROVAL OF A SECOND AMENDMENT TO A
PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF DENTON AND PAPE-
DAWSON ENGINEERS, LLC, AMENDING THE CONTRACT APPROVED BY CITY
COUNCIL ON JULY 17, 2018, IN THE NOT-TO-EXCEED AMOLJNT OF $607,550, AMENDED
BY AMENDMENT 1 APPROVED BY PURCHASING STAFF IN THE NOT-TO EXCEED
AMOUNT OF $638,050; SAID SECOND AMENDMENT TO PROVIDE FOR PROFESSIONAL
SERVICES RELATED TO THE 2019 STREET RECONSTRUCTION PROJECT TO
RECONSTRUCT THE ROADWAYS, REPLACE DAMAGED CURB AND GUTTER,
ANALYSIS OF TWO DRAINAGE AREAS, AND 1NVENTORY THE SIDEWALKS ALONG
ROADWAYS AND TO PROVIDE CONSTRUCTION SERVICES SUCH AS REVIEW OF
SUBMITTAL, REQUESTS FOR 1NFORMATION, CHANGE ORDER, ETC.; PROVIDING FOR
THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE
(FILE 6590-006 — PROVIDING FOR AN ADDITIONAL AMENDMENT EXPENDITURE
AMOUNT NOT-TO-EXCEED $36,000, WITH THE TOTAL CONTRACT AMOUNT NOT-TO-
EXCEED $674,050).
WHEREAS, on July 17, 2018, by Ordinance No. 18-1107, the City awarded a contract to
Pape-Dawson Engineers, LLC in the amount of $607,550 for 2019 for the 2019 Street
Reconstruction Project; and
WHEREAS, on September 16, 2019, Purchasing approved a first amendment to the contract
between the City of Denton and Pape-Dawson Engineers, LLC in the amount of $30,500; and
WHEREAS, the additional fees under the proposed Second Amendment are fair and
reasonable and are consistent with and not lugher than the recommended practices and fees
applicable to the Provider's profession and such fees do not exceed the maximum provided by law;
NOW, THEREFORE,
THE COUNCII, OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The Second Amendment, increasing the amount of the contract between the
City and Pape-Dawson Engineers, LLC, which is on file in the office of the Purchasing Agent, in the
amount of Thirty-Six Thousand and 00/100 ($36,000) Dollars, is hereby approved and the
expenditure of funds therefor is hereby authorized in accordance with said amendment. The total
contract amount increases to $674,050.
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval.
