ORDINANCE NO. PD19-0003c
AN ORDINANCE OF THE CITY OF DENTON, TEXAS, NUNC PRO TUNC, CORRECTING
AN INADVERTANT MISTAKE IN ORDINANCE NO. PD19-0003a RELATING TO THE
DEVELOPMENT PLAN MAP; PROVIDING FOR A SAVINGS CLAUSE AND AN
EFFECTIVE DATE. (PD19-0003c)
WHEREAS, on December 17, 2019, the City Council approved Ordinance No. PD 19-0003a
relating to a zoning change from Residential2 (R2) District on 34.31 acres ofland and Residential
3 (R3) District on 2.34 acres of land to Planned Development (PD) District on a total of 36.66
acres ofland, generally located on the north side ofRyan Road approximately 120 feet east of
Monte Carlo Lane; and
WHEREAS, City Staff discovered an inadvertent mistake in the Exhibit attached to the
signed copy of Ordinance No. PD19-0003a, which resulted in an ordinance that did not accurately
reflect what the City Council intended to approve; and
WHEREAS, City Staff requests that the inadvertent mistake be revised to correctly reflect
the intention of the Cit y Council in Ordinance No. PD19-0003a, as provided in Exhibit A ; and
WHEREAS, the City Council has the inherent power to retroactively correct such mistakes
to accurately reflect is official actions; and
WHEREAS, the City Council finds that said correction i s in the best interest of the
citizens of the City ofDenton and should be adopted as stated herein; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS :
SECTION 1. The findings and recitations contained in the preamble ofthis ordinance are
incorporated herein by reference and found to be true.
SECTION 2. The Development Plan Map, attached as Exhibit "D" to Ordinance No.
PD19-0003a, is hereby amended to reflect the revised Development Plan Map distributed in
hard copy to the City Council at the December 17, 2019, meeting and subsequently
incorporated in the motion for approval.
SECTION 3 . All other provisions of Ordinance No. PD19-0003a not specifically amended
or deleted herein shall continue in full force and effect from the date of original passage on
December 17,2019.
SECTION 4. This Ordinance shall become effective immediately upon its passage and
approval.

GENERAL NOTES:
1.All bearings shown are based on grid north of the Texas Coordinate System of 1983, North
Central Zone 4202, using the City of Denton control monumentation. All dimensions shown
are ground distances. To obtain a grid distance, multiply the ground distance by the Project
Combined Factor (PCF) of 0.999850925.
2.Selling a portion of this addition by metes and bounds is a violation of City ordinance and
state laws and is subject to fines and withholding of utilities and building permits.
3.Taps made to existing waterlines or relocation of fire hydrant shall be done by the City of
Denton at the Contractor's expense. Contact the Water Department at 940-349-7181.
4.Taps made to existing sewer lines shall be done by the City of Denton at the Contractor's
expense. Contact the Wastewater Department at 940-349-8489.
5.According to Map No. 48121C0390G dated April 18, 2011, of the National Flood Insurance
Program Map of Denton County, Texas, Federal Emergency Management Agency, Federal
Insurance Administration, a portion of this property is located in Zone X, which is a minimal
flood hazard area. If this site is within an identified special flood hazard area, this flood
statement does not imply that the property and/or the structures thereon will be free from
flooding or flood damage. On rare occasions, greater floods can and will occur and flood
heights may be increased by man-made or natural causes. This flood statement shall not
create liability on the part of the surveyor.
6.IMPORTANT NOTICE: THE CITY OF DENTON HAS ADOPTED THE NATIONAL
ELECTRICAL SAFETY CODE (THE “CODE”). THE CODE GENERALLY PROHIBITS
STRUCTURES WITHIN 17.5 FEET ON EITHER SIDE OF THE CENTER LINE OF
OVERHEAD DISTRIBUTION LINES AND WITHIN 37.5 FEET ON EITHER SIDE OF THE
CENTERLINE OF OVERHEAD TRANSMISSION LINES. IN SOME INSTANCES THE CODE
REQUIRES GREATER CLEARANCES. BUILDING PERMITS WILL NOT BE ISSUED FOR
STRUCTURES WITHIN THESE CLEARANCE AREAS. CONTACT THE BUILDING
OFFICIAL WITH SPECIFIC QUESTIONS.
Such clearance provisions shall be included in the design and construction when real property
is developed or altered. Such clearance areas shall be recorded by the property developer or
by the record owner on subdivision plats; or shall be evidenced by written instrument, duly
recorded, in the Public Records of Denton County, Texas. Unobstructed and adequate space
shall be provided for all clearance areas in such way that will allow the ingress and egress for
utility-related personnel and equipment to perform operations, maintenance and replacement
of electrical supply and communication lines. Maintenance of clearance areas and/or
easements shown on this plat are the responsibility of the individual property owners and do
not constitute acceptance of same for maintenance purposes by the City of Denton.
7.The Common Area Lots, Block A, Lot 1X-HOA, Teasley Trails Phase 1B Block D, Lot 16,
Block D Lot 1X HOA, Block E, Lot 1X-HOA, and Block F, Lot 1X-HOA, are to be owned and
maintained by the Homeowners Association (H.O.A.). Open spaces shall also be designated
as drainage easements.
8.All portions of retaining walls and pedestrian rails located in open spaces, shall be
privately owned and maintained by the Home Owners Association (H.O.A.).
9.No fences shall be installed across HOA lots.
10.Acceptance of the drainage features identified on the General Development Plan are
subject to change during the plat process and do not constitute subsequent approval of
same. The City reserves the right to require additional data or studies to ensure
compliance with City of Denton Subdivision and Land Regulations, Drainage Design
Criteria and Comprehensive Master Drainage Plan.
11.Developments that will generate over 1000 vehicle trips per day or more than 100
vehicle trips during the peak hour as determined during the general development plan,
preliminary or final plat review, must submit a Traffic Impact Analysis (TIA), for the entire
development, prior to a Final Plat submission.
12.All future preliminary and final plats, within the limits of the General Development Plan,
must conform to the General Development Plan.
13.Project is proposed to be constructed as one phase.
14.Open space/HOA lots provided to buffer existing neighborhood from proposed single
family lots and provide preservation of existing trees located near property boundary.
15.Tree preservation will be finalized with the final plat and the development will meet the
2002 DDC requirements.
