AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZiNG THE APPROVAL OF A FIF'TH AMENDMENT TO A
PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF DENTON AND
TEAGUE NALL AND PERKINS,INC., AMENDING THE CONTRACT APPROVED BY THE
CITY MANAGER ON APRIL 10, 2017, IN THE NOT-TO-EXCEED AMOLTNT OF $93,500;
AMENDED BY AMENDMENTS 1- 4 APPROVED BY CITY COUNCIL, CITY MANAGER
AND PURCHASING STAFF; SAID FIFTH AMENDMENT TO PROVIDE ENGINEERING AND
DESIGN SERVICES RELATING TO THE HICKORY CREEK ROAD WEST PROJECT;
PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN
EFFECTIVE DATE (FILE 6427 — PROVIDING FOR AN ADDITIONAL FIFTH AMENDMENT
EXPENDITURE AMOUNT NOT-TO-EXCEED $67,635, WITH THE TOTAL CONTRACT
AMOUNT NO-TO-EXCEED $293,185).
WHEREAS, on April 10, 2017, the City Manager awarded a contract to Teague Nall &
Perkins, Inc. in the amount of $93,500 to provide engineering and design services relating to the
Hickory Creek Road West project; and
WHEREAS, on July 18, 2017, by Ordinance No. 2017-194, the City awarded a first
amendment to the contract between the City of Denton and Teague Nall & Perkins, Inc. in the
amount of $39,800; and
WHEREAS, on August 6, 2018, the Purchasing Department awarded a second amendment to
the contract between the City of Denton and Teague Nall & Perkins, Inc. in the amount of $40,400;
and
WHEREAS, on October 23, 2018, the Purchasing Department awarded a third amendment to
the contract between the City of Denton and Teague Nall & Perkins, Inc. in the amount of $6,300;
and
WHEREAS, on December 13, 2018, the City Manager awarded a fourth amendment to the
contract between the City of Denton and Teague Nall & Perkins, Inc. in the amount of $45,550; and
WHEREAS, the additional fees under the proposed Fifth Amendment are fair and reasonable
and are consistent with and not higher than the recommended practices and fees applicable to the
Provider's profession and such fees do not exceed the maximum provided by law; NOW,
THEREFORE,
THE COUNCII, OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The Fifth Amendment, increasing the amount of the contract between the City and
Teague Nall & Perkins, Inc., which is on file in the office of the Purchasing Agent, in the amount of
Sixty-Seven Thousand Six Hundred Thirty-Five and 00/100 Dollars ($67,635.00), is hereby
approved and the expenditure of funds therefor is hereby authorized in accordance with said
amendment. The total contract amount increases to $293,185.
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval.
