OR HIS DESIGNEE, TO CONVEY A SUPPLEMENTAL TRANSMISSION LINE EASEMENT AND A TEMPORARY CONSTRUCTION EASEMENT TO ONCOR ELECTRIC DELIVERY COMPANY LLC. CONTAINING APPROXIMATELY A TOTAL OF 0.9064 ACRES ON A TRACT OF CITY OWNED PROPTERY IN THE MOREAU FORREST SURVEY. ABSTRACT NO. 417, CITY AND COUNTY OF DENTON, TEXAS, PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, Oncor Electric Delivery, LLC (“Oncor”) has requested that the City of Denton (“City”) grant Oncor a Supplemental Transmission Line Easement and a Temporary Construction Easement (collectively, the “Easements”) containing approximately a total of 0.9064 acres on a tract of city owned property located at Geesling Road, and more particularly described in Exhibits “A“ and “B” attached to the Easements hereto and made a part hereof for all purposes (the “Property Interest”); and WHEREAS, the City agrees to grant, sell, and convey to Oncor the Easements for a total of Five Thousand Dollars ($5,000.00); and WHEREAS, the City Council hereby finds the conveyance to Oncor will benefit and serve the public; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings set forth in the preamble of this Ordinance are incorporated by reference into the body of this Ordinance as if fully set forth herein. , SECTION 2. The City Manager, or his designee, is authorized to execute and deliver to Oncor Electric Delivery, LLC. the Supplemental Transmission Line Easement, attached hereto as Exhibit 1, and the Temporary Construction Easement, attached hereto as Exhibit 2, with the legal descriptions of each being attached respectively thereto as Exhibits 'W’ and “B.” SECTION 3. If any section, article, paragraph, sentence, phrase, clause, or word in this ordinance, or application thereof to any persons or circumstances, is held invalid or unconstitutional by a court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; the City Council declares that it would have ordained such remaining portion despite such invalidity, and such remaining portion shall remain in full force and effect. SECTION 4. This ordinance shall become effective immediately upon its passage and approval. RECITALS A. Grantor is the owner of certain property in Denton County, Texas, encumbered by that certain Easement granted to Grantee on February 6, 2018 and recorded at Volume , Page of the Deed Records of Denton County, Texas (the “Easement”). B. The Easement gives Grantee a perpetual easement and right of way for electric power lines as is more particularly described in the Easement. C. Grantee desires to expand the area encumbered by the Easement to include additional land, as shown on Exhibit “A“ and depicted in Exhibit “B” attached hereto and made a part hereof (the “Additional Land”). NOW, THEREFORE, for and in consideration of Ten and No/100 Dollars ($10.00) and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Grantor and Grantee hereby agree as follows: AGREEMENT Grantor hereby grants, sells, and conveys an easement to Grantee over the Additional Land upon the terms and conditions set forth in the Easement. The foregoing grant of easement by Grantor shall be subject to all of the terms, provisions, conditions, limitations, and restrictions set forth in the Easement which is ratified by Grantor and Grantee and shall continue in full force and effect as supplemented herein. This Supplemental Easement, and the terms and conditions contained herein, shall inure to the benefit of and be binding upon Grantee and Grantor, and their respective personal representatives, successors, and assigns. This Supplemental Easement shall be construed and interpreted in accordance with the laws of the State of Texas.
