(PDA20-0001 a; STONEHILL CENTER) WHEREAS, Aimee Bissett (“Applicant“), on behalf of the property owner LAD Ventures LL(_-> initiated a request to amend the Detailed Plan for Planned Development District 142 (PD- 142), approved by Ordinance No. 91-101, 1egally described as Lot 1-R, Block A, Exposition Mills (''Property“), now known as Stonehill Center; and WHEREAS, the Detailed Plan for the Property was approved by the Planning and Zoning Commission on April 22, 1992, and subsequently amended several times; and WHEREAS, on November 4, 2014, the City Council approved a Detailed Plan Amendment for PD-142 by Ordinance No. 2014-375, which depicted four buildings arranged on the Property; and WHEREAS, the Applicant seeks to amend the Detailed Plan to allow for the construction of a 309000 square foot, single story office building on the Property depicted as “Building 1“ in Exhibit “A,” attached hereto; and WHEREAS, on May 6, 2020, the Planning and Zoning Commission, in compliance with the laws of the State of Texas, gave the requisite notices by publication and otherwise, held a public hearing for all property owners interested in this regard, and recommended approval [7-0] of the amendment; and WHEREAS, on May 19, 2020, the City Council likewise conducted a public hearing as required by law, and finds that the request meets and complies with all substantive and procedural standards for a Detailed Plan Amendment set forth in Section 35-152 of the 1991 City of Denton Zoning Ordinance; and WHEREAS> the Planning and Zoning Commission and the City Council of the City of Denton9 have determined that the proposed Detailed Plan Amendment is in the best interest of the health, safety, morals, and general welfare of the City of Denton, and accordingly, the City Council of the City of Denton is of the opinion and finds that said Detailed Plan Amendment is in the public interest and should be granted as set forth herein; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. Architecture for all buildings must maintain consistent themes and include the following elements: a. Colonnade for a minimum of fifty (50) percent of the facade facing public areas b. Varied roof parapet line for fifty (50) percent of the facade facing public areas c. Decorative tower on at least two (2) corners. The tower must be a minimum of five (5) feet taller than the surrounding roof line. SECTION 3. The provisions of this ordinance, as they apply to PD-142 shown in Exhibit A are herein approved and shall govern and control over any conflicting provision of Ordinance No. 91-101 and prior Detailed Plan approvals, whether by ordinance or administrative action by the Planning and Zoning Commission, but all provisions of Ordinance No. 91-101 as they apply to that remaining portion of the PD district not herein affected shall continue in force and effect and apply to the remainder of the PD district. SECTION 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of the provisions or applications, and to this end the provisions of this ordinance are severabie. SECTION 5. Any person, firm, partnership or corporation violating any provision of this ordinance shall, upon conviction, be deemed guilty of a misdemeanor and shall be punished by fine in a sum not exceeding $2,000.00 for each offense. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 6. In compliance with Section 2.09(c) of the Denton Charter, this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record- Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage. 2 of 3 SECTION 2.
