20-1019ORDINANCE NO.20-1019 AN ORDINANCE OF THE CITY OF DENTON AUTHORIZING THE CITY MANAGER TO (1) MAKE APPLICATION TO THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS EMERGENCY SOLUTIONS GRANT PROGRAM FOR GRANT FUNDING AVAILABLE THROUGH THE CORONAVIRUS AID, RELIEF, AND ECONOMIC SECURITY ACT (CARES ACT) WITH APPROPRIATE CERTIFICATIONS AND (I1) TO TAKE ALL OTHER ACTIONS NECESSARY TO OBTAIN FUNDING AND IMPLEMENT THE PROGRAM; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Denton is concerned with the development of viable urban communities, including decent housing, a suitable living environment, and expanded economic development opportunities; and WHEREAS, the City of Denton has a special concern for making homelessness rare, brief, and nonrecuning; and WHEREAS, the Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public Law 1 16-136, was signed by President Trump on March 27, 2020, to respond to the growing effects of this historic public health crisis, and allocated $2 billion in Emergency Solutions Grant Program (ESG-CV) funds, to provide additional funding to state and local governments; and WHEREAS, the Texas Department of Housing and Community Affairs (TDHC A) received $33,254,679.00 in one-time funding of ESG-CV Program funds to be used to prevent, prepare for, and respond to COVID- 19; and WHEREAS, the TDHCA selected the Texas Balance of State Continuum of Care (Co(,-) as one of eight coordinators for the ESG-CV fund allocations available in the CoC Region and made available $6,928,889.00 for CoC distribution; and WHEREAS, the City of Denton is included and participates in the CoC; and WHEREAS, the City desires to apply to the CoC for ESG-CV Program funds; and WHEREAS, the City of Denton intends to procure and contract with local social service agencies to provide eligible services through the ESG-CV Program; and WHEREAS, the TDHCA requires specific certifications and the City Council deems it in the public interest to authorize the City Manager to apply for ES(J-CV funding and execute a grant agreement; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference. SECTION 2. The City Manager is authorized to sign and submit a grant application to the Texas Department of Housing and Community Affairs and all appropriate officials thereof, together with all necessary certifications, grant agreements, and other documents as well as appropriate resources for entitlement of funds under the Stewart B. McKinney Homeless Assistance Act of 1987 as amended, and the Emergency Solutions Grant Program pursuant to See. 2306.094 of the Texas Government Code, and the Coronavirus Aid, Relief, And Economic Security Act (CARES Act), which includes waivers of certain provisions of the ESG regulations, and other applicable laws, as necessary to obtain a grant under the ESG-CV Program to provide services to people experiencing and at-risk of homelessness. SECTION 3. The City Manager is further authorized to take all other actions necessary to execute an agreement and administer this grant. SECTION 4. The Community Services Manager is authorized to carry out the duties and obligations of the ESG-CV Program, if the City is selected to receive funding. SECTION 5. The City Secretary is hereby authorized to furnish copies of the ordinance to all interested parties. SECTION 6. This ordinance shall become effective immediately upon its passage and approval.
