20-789ORDINANCE NO. 20-789 AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME -RULE MUNICIPAL CORPORATION, APPROVING AND AUTHORIZING THE EXPENDITURE OF FUNDS (NOT TO EXCEED $50,000 A YEAR FOR FIVE YEARS WITH A TOTAL NOT TO EXCEED AMOUNT OF $250,000) FOR THE PAYMENT OF FEES DUE UNDER THE PIPELINE TRANSPORATION AGREEMENT BETWEEN THE CITY AND ATMOS PIPELINE - TEXAS, A DIVISION OF ATMOS ENERGY CORPORATION, A TEXAS AND VIRGINIA CORPORATION, APPROVED UNDER ORDINANCE NO. 18-292 AND REQUIRED FOR THE PURCHASE OF NATURAL GAS FOR USE BY THE CITY'S SOLID WASTE DEPARTMENT; AND, PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Denton, a Texas home -rule municipal corporation ("Denton"), and Atmos Pipeline - Texas, a Division of Atmos Energy Corporation, a Texas and Virginia corporation ("Atmos"), through Ordinance No. 18-292, entered into a Pipeline Transportation Agreement ("Agreement") which sets out the terms, conditions, and fees by which Denton can have natural gas transported to the City's Alternative Fuel Facility located at ECOWERCS by Atmos; and WHEREAS, the City's Solid Waste Department uses pipeline -grade natural gas as fuel for its compressed natural gas vehicles with said gas being transported to its Alternative Fuel Facility by Atmos through the Atmos pipeline infrastructure; and WHEREAS, the City's Solid Waste Department seeks funding authorization for gas transportation fees under the Agreement in an amount not to exceed $50,000 per year for the next five years with a total not to exceed amount of $250,000; and WHEREAS, this funding authorization was considered by Denton's Public Utilities Board ("PUB") on June 22, 2020; a majority of the PUB convened as permitted by law to discuss this funding authorization; and, thereafter proceeded to take final action and, by a vote of 156C ( __6_ ) in favor to -JX e-0 ( Q ) opposed, recommended to the City Council that the funding authorization be approved; and WHEREAS, the City Council has finds that the funding authorization is in the best interest of the public and should be approved and authorized; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The recitations contained in the above recitals are incorporated herewith and are considered to be a part of this Ordinance. SECTION 2. The City Council approves and authorizes the City Manager to spend no more than $50,000 per year over the next five years from budgeted funds for the payment of transportation fees in accordance with the Pipeline Transportation Agreement approved by City Council under Ordinance No. 18-292. SECTION 3. This ordinance shall become effective immediately upon its passage and approval.
