20-1385ORDINANCE NO. 20-1385 AN ORDINANCE OF THE CITY OF DENTON, IN COMPLIANCE WITH GOVERNOR ABBOTT'S EXECUTIVE ORDERS REGARDING OUTDOOR GATHERINGS, AUTHORIZING THE 2020 BACK -TO -SCHOOL DRIVE THRU SUPPLY DISTRIBUTION EVENT ORGANIZED BY THE UNITED WAY OF DENTON COUNTY AND OTHER COMMUNITY PARTNERS AT FIRST DENTON, 1100 MALONE STREET, TO PROVIDE DENTON INDEPENDENT SCHOOL DISTRICT COUNSELORS WITH SCHOOL SUPPLIES TO PROVIDE TO STUDENTS IN NEED; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, beginning in December 2019, a novel coronavirus, now designated SARS- CoV2 which causes the disease COVID-19, has spread throughout the world and is a declared global pandemic by the World Health Organization; and WHEREAS, Governor Greg Abbott has issued executive orders for the State of Texas to take extraordinary measures to contain COVID-19 and prevent its spread throughout the State, including the limitation of community gatherings; and WHEREAS, on July 2, 2020, Governor Abbott issued a proclamation to amend Executive Order GA -28, wherein any outdoor gathering in excess of 10 people, other than those set forth in paragraph numbers 1, 2, or 4 in GA -28, are prohibited unless the mayor of the city in which the gathering is held, or the county judge in the case of a gathering in an unincorporated area, approves of the gathering, and such approval can be made subject to certain conditions or restrictions not inconsistent with GA -28 ; and WHEREAS, the United Way of Denton County and other community partners are organizing a Back -to -School Supply Distribution Event ("Event") to provide school supplies to Denton Independent School District counselors for them to distribute to students in need; and WHEREAS, the Event is proposed to take place on Monday, August 10, from 9:00 a.m. to noon, and from Wednesday, August 12 through Friday, August 14, from 9:00 a.m. to 4:00 p.m.; each day as a drive-thru distribution event outdoors at First Denton, 1100 Malone Street, Denton, TX, 76201; and WHEREAS, it is possible that there may be over 10 individuals at the outdoor gathering in order for volunteers to organize supplies and provide them to school counselors; and WHEREAS, the United Way of Denton County is requesting approval of the Event as an outdoor gathering from City of Denton Mayor Watts in compliance with Governor Abbott's proclamation; and WHEREAS, the City Council finds that it is in the best interest of the citizens of the City of Denton to approve the Event based upon the services being provided to the community and the health and safety precautions being taken for the Event as outlined in the attached Exhibit; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in this preamble of this Ordinance are incorporated herein by reference. SECTION 2. The City Council authorizes Mayor Watts to approve the Event as proposed in compliance with Governor Abbott's executive order. SECTION 3. This Ordinance shall become effective immediately upon its passage and approval.
