AN ORDINANCE BY THE CITY OF DENTON AUTHORIZING THE CITY MANAGER TO
SIGN AND SUBMIT TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
A 2020-2022 CONSOLIDATED PLAN FOR HOUSNG AND COMMUNITY DEVELOPMENT
AND 2020 ACTION PLAN WITH APPROPRIATE CERTIFICATIONS, AS AUTHORIZED
AND REQUIRED BY THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974,
AS AMENDED, AND THE NATIONAL AFFORDABLE HOUSING ACT OF 1990, AS
AMENDED, AUTHORIZING THE COMMUNITY SERVICES MANAGER AND
COMMUNITY DEVELOPMENT COORDINATOR TO SIGN RELEASE OF LIENS AND
SUBORDINATION AGREEMENTS UPON CERTAIN CONDITIONS; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the City of Denton is concerned with the development of viable urban
communities, including decent housing, a suitable living environment and expanded economic
development opportunities; and
WHEREAS, the City of Denton has a special concern for persons of low and moderate
income; and
WHEREAS, the City of Denton, as a Community Development Block Grant (CDBG)
Entitlement City and a Home Investment Partnerships (HOME) Participating Jurisdiction, has
prepared, through a citizen participation process, a 2020-2022 Consolidated Plan for Housing and
Community Development (Con Plan); and
WHEREAS, the City of Denton, as a Community Development Block Grant (CDBG)
Entitlement City and a Home Investment Partnerships (HOME) Participating Jurisdiction, has
prepared, through a citizen participation process, an action plan for utilizing its 2020 -year
entitlement funds, program income, and reallocated funding from previous years in the
approximate amount of $1,786,516 (the "2020 Action Plan"); and
WHEREAS, citizen participation requirements, including the holding of public hearings,
have been met; and
WHEREAS, the Community Development Act of 1974, as amended, and the National
Affordable Housing Act of 1990, as amended, require an application and appropriate certification
included in the Consolidated Plan; and
WHEREAS, implementation of the 2020 Action Plan will require the execution of release
of liens or subordination agreements related to the financing provided therein; NOW,
THEREFORE:
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference.
SECTION 2. The City Council of the City of Denton authorizes the City Manager to sign
and submit to the Department of Housing and Urban Development a 2020 Action Plan, and
appropriate certifications for entitlement funds under the Housing and Community Development
Act of 1974, as amended, and the National Affordable Housing Act of 1990, as amended.
SECTION 3. The City Council of the City of Denton authorizes the Community Services
Manager to handle all fiscal and administrative matters related to the application, the 2020 Action
Plan, and the certifications, including any proportional increases or decreases in project or program
funding required to match allocation amounts.
SECTION 4. The Community Services Manager and Community Development
Coordinator are hereby authorized to execute release of liens, as approved by the City Attorney's
Office, related to the funding provided through the 2020 Action Plan upon the full and complete
payment of any and all outstanding indebtedness and in full compliance with residency
requirements.
SECTION 5. The Community Services Manager and Community Development
Coordinator are hereby authorized to execute subordination, or similar, agreements, as approved
by the City Attorney's Office, related to the funding provided through the 2020 Action Plan upon
the refinancing of borrower's preexisting mortgage loan provided borrower is in full compliance
with the terms and conditions of the City -provided financing.
SECTION 6. The City Secretary is hereby authorized to famish copies of the ordinance to
all interested parties.
SECTION 7. This ordinance shall become effective immediately upon its passage and
approval.
