AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME -RULE MUNICIPAL
CORPORATION, AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO
EXECUTE APPROVAL DOCUMENTS UNDER THE JOINT OPERATING AGREEMENT BY
AND BETWEEN THE TEXAS MUNICIPAL POWER AGENCY, CITY OF BRYAN, TEXAS,
THE CITY OF DENTON, TEXAS, THE CITY OF GARLAND, TEXAS, AND THE CITY OF
GREENVILLE, TEXAS REGARDING THE TMPA BUDGET FOR THE FISCAL YEAR 2021;
PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFORE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Denton, a Texas municipal home -rule corporation, is a member
city of the Texas Municipal Power Agency ("TMPA"), a Joint Powers Agency; and TMPA
consists of four cities, being the Cities of Bryan, Texas, Denton, Texas, Garland, Texas, and
Greenville, Texas ("Member Cities"); and
WHEREAS, the principal governance agreement between TMPA and Member Cities is
the Joint Operating Agreement, as amended, which addresses the budgetary issues of TMPA; and
WHEREAS, the Joint Operating Agreement requires the approval of all participating public
entities if the TMPA annual budget requires a twenty percent or greater increase over the previous
year's budget; and
WHEREAS, the TMPA board has approved a budgetary increase of twenty percent or
greater by its Resolution Number 2020-6-1; NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON ORDAINS:
SECTION 1. The recitals in the preamble are true and correct and are incorporated herewith
by reference.
SECTION 2. The City Manager, or his designee, is authorized to execute and deliver
documents approving the TMPA FY2021 budget on behalf of the City of Denton.
SECTION 3. This ordinance shall be and become effective immediately upon and after its
adoption and approval; provided however, that the Texas Municipal Power Agency, the City of
Bryan, Texas, the City of Garland, Texas, and the City of Greenville, Texas have each approved
said TMPA budget for Fiscal Year 2021.
