AN ORDINANCE OF THE CITY OF DENTON AUTHORIZING THE CITY MANAGER, OR
HIS DESIGNEE, TO ACCEPT ON BEHALF OF THE CITY AN OFFER FROM THE TEXAS
DEPARTMENT OF TRANSPORTATION ("TxDOT") RELATING TO A GRANT OF
$369,650.00 FOR DESIGN COSTS WITH THE CITY RESPONSIBLE FOR TEN PERCENT
OF DESIGN COSTS OVER THAT AMOUNT; REQUIRING THE CITY TO PROVIDE
$495,810.00 IN CONTRIBUTORY FUNDS FOR CONSTRUCTION OF THE ANTICIPATED
IMPROVEMENTS; ALL FOR PRIMARY RUNWAY REHABILITATION DESIGN AND
CONSTRUCTION AT THE DENTON ENTERPRISE AIRPORT; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Denton ("City") intends to make certain improvements to the
primary runway at the Denton Enterprise Airport; and
WHEREAS, the project generally consists of engineering and construction of rehabilitation
improvements for the primary runway (the "Project"); and
WHEREAS, the City intends to request financial assistance from the Texas Department of
Transportation ("TxDOT") for the Project; and
WHEREAS, the total Project cost is estimated to be $5,354,750.00 with the City's
contribution estimated to be $495,810.00, calculated as follows:
• Design cost is estimated to be $396,650.00, and the City will be responsible
for 10% of the design project costs over the amount, and
• Construction cost is estimated to be $4,958,100.00, and the City of Denton
will be responsible for 10% of the total construction costs currently
estimated to be $495,810.00; and
WHEREAS, the Council Airport Committee on July 24, 2020 voted to recommend Council
approval by a vote of [3 - 0]; and
WHEREAS, the City of Denton names Tx DOT as its agent for the purposes of applying
for, receiving, and disbursing all funds for these improvements and for the administration of
contracts necessary for the implementation of these improvements; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitals contained in the preamble of this ordinance are
incorporated herein by reference as true and as if fully set forth in the body of this ordinance.
SECTION 2. The City of Denton hereby authorizes the City Manager, or his designee, to
execute on behalf of the City all contracts and agreements with the State of Texas, represented by
TxDOT, for the financial assistance and implementation of the Project at the Denton Enterprise
Airport, including the forms attached hereto as Exhibit "A."
SECTION 3. The City Manager, or his designee, is further authorized to carry out all
duties and responsibilities to be performed by the City under the offer for the completion of the
Project, including, but not limited to, the expenditure of funds.
SECTION 4. This Ordinance shall become effective immediately upon its passage and
approval.
