20-141620-1416 ORDINANCE NO. AN ORDINANCE OF THE CITY OF DENTON, TEXAS, EXTENDING THE EFFECTIVE PERIOD OF THE DECLARATION OF DISASTER CONCERNING GREEN TREE ESTATES, A SUBDIVISION LOCATED WITHIN THE LIMITS OF THE CITY, TO AUGUST 31, 2020; AUTHORIZING THE CONTINUED EXPENDITURE OF A TOTAL AMOUNT NOT TO EXCEED $100,000 DURING THIS ENTIRE DISASTER DECLARATION PERIOD AS AUTHORIZED BY CITY COUNCIL ON NOVEMBER 15, 2019; AND, PROVIDING AN EFFECTIVE DATE. WHEREAS, on November 13, 2019, the Mayor executed a Declaration of Disaster concerning Green Tree Estates; WHEREAS, on November 15, 2019, the City Council, by Ordinance No. 20-2784, extended the Declaration of Disaster for an additional ninety days ("Disaster Declaration Period") and authorized the City Manager to expend from budgeted funds not more than a total of $100,000 during the Disaster Declaration Period to assist the residents of Green Tree Estates; WHEREAS, on February 4, 2020, the City Council, by Ordinance No. 20-293, extended the Disaster Declaration Period to May 22, 2020 and continued the City Manager's expenditure authorization as set forth in Ordinance No. 19-2784 during the Disaster Declaration Period; WHEREAS, on May 12, 2020, the City Council, by Ordinance No. 20-960, extended the Disaster Declaration Period to July 31, 2020, and continued the City Manager's expenditure authorization as set forth in Ordinance No. 19-2784 during the Disaster Declaration Period; WHEREAS, the City Council finds that it is in the best interest of the citizens of the City of Denton to extend the Disaster Declaration Period to August 31, 2020 and continue the City Manager's authorization for the expenditure of no more than a total of $100,000 during the Disaster Declaration Period for the matters set forth in Ordinance No. 20-960; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The facts, circumstances and recitations contained in the preamble of this Ordinance, are found and declared to be true and correct. SECTION 2. The findings set forth in the preamble of this Ordinance are incorporated by reference into the body of this Ordinance as if fully set forth herein. SECTION 3. Pursuant to Section 418.108(b), Texas Government Code, and Section 9- 27, City of Denton Code of Ordinances, the effective period of Declaration of Disaster executed by the Mayor on November 13, 2019, extended for an additional ninety days by the City Council under Ordinance No. 19-2784, extended to May 22, 2020 by the City Council under Ordinance No. 20-293, further extended to July 31, 2020 under Ordinance No. 20-960, is extended until August 31, 2020 so (i) the City may continue to offer the residents of Green Tree Estates (a) potable water in small sealed containers for consumption and personal hygiene, (b) non -potable water in larger containers for other use (including the operation of toilets), and (c) large containers for storage of non -potable water; and, (ii) the City shall, if one or more of the fee simple property owners in Green Tree Estates elects to connect to the City water system and pays all connection - related fees in full by July 3, 2020, extend, at the City's cost which is not -to -exceed $10,000.00, City water service from the water main located near Evening Wind Rd. to the easternmost boundary of the Green Tree Estates subdivision. SECTION 4. That the City Manager, or his designee, is authorized to expend from budgeted funds not more than a total of $100,000 during the Disaster Declaration Period set forth above so the City (i) may continue to offer the residents of Green Tree Estates (a) potable water in small sealed containers for consumption and personal hygiene, (b) non -potable water in larger containers for other use (including the operation of toilets), and (c) large containers for storage of non -potable water. SECTION 5. All other provisions of Ordinance Nos. 19-2784, 20-293, and 20-960 not in conflict with this ordinance remain in effect. SECTION 6. That this ordinance shall become effective immediately upon its passage and approval.
