AN ORDINANCE OF THE CITY OF DENTON, TEXAS, REGARDING A CHANGE IN THE
ZONING DISTRICT AND USE CLASSIFICATION FROM LIGHT INDUSTRIAL (LI) AND
GENERAL OFFICE (GO) TO MIXED-USE REGIONAL (MR) WITH OVERLAY
CONDITIONS ON APPROXIMATELY 98 ACRES, INCLUDING ONE ACRE GENERALLY
LOCATED AT THE NORTHWEST INTERSECTION OF SOUTH LOOP 288 AND SHADY
OAKS DRIVE (TRACT 1); 72.76 ACRES LOCATED AT THE SOUTHWEST CORNER OF
SOUTH LOOP 288 AND SHADY OAKS DRIVE (TRACT 2), AND 24.14 ACRES LOCATED
ON THE SOUTH SIDE OF SHADY OAKS DRIVE (TRACT 3), LOCATED
APPROXIMATELY 1900 FEET WEST OF SOUTH LOOP 288, IN THE CITY OF DENTON,
DENTON COUNTY, TEXAS; ADOPTING AN AMENDMENT TO THE CITY'S OFFICIAL
ZONING MAP; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00
FOR VIOLATIONS THEREOF; PROVIDING A SEVERABILITY CLAUSE AND AN
EFFECTIVE DATE. (Z19-0012)
WHEREAS, Medjano Partners, has applied for a zoning change on approximately 98 acres
of land legally described in Exhibit "A," attached hereto and incorporated herein by reference
(hereinafter, the "Property"), from Light Industrial (LI) and General Office (GO) Districts to
Mixed -Use Regional (MR) District zoning district and use classification; and
WHEREAS, on March 4, 2020, the Planning and Zoning Commission, in compliance with
the laws of the State of Texas, gave the requisite notices by publication and otherwise, and held a
public hearing and afforded a full and fair hearing to all property owners interested in this regard,
and recommended approval (6-0) of the amendment; and
WHEREAS, on June 16, 2020, the City Council likewise conducted a public hearing as
required by law and approved the request, finding that the zoning change meets and complies with
all substantive and procedural standards set forth in Section 2.7.2 of the Denton Development
Code, and is consistent with the Denton Plan 2030 and the Denton Development Code;
WHEREAS, on June 23, 2020, the City Council approved the motion to reconsider the
zoning change; and
WHEREAS, on July 21, 2020, the City Council conducted a public hearing as required by
law to reconsider the zoning change. Upon reconsideration, the City Council finds that the zoning
change meets and complies with the Denton Development Code and is consistent with the Denton
Plan 2030;
WHEREAS, the Planning and Zoning Commission and the City Council of the City of
Denton, in considering the application for a change in the zoning classification of the property,
have determined that the proposed use is in the best interest of the health, safety, morals, and
general welfare of the City of Denton, and accordingly, the City Council of the City of Denton is
of the opinion and finds that said zoning change is in the public interest and should be granted as
set forth herein; NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference and found to be true.
SECTION 2. The zoning district and use classification for the Property is hereby changed
from Light Industrial (LI) and General Office (GO) Districts to Mixed -Use Regional (MR) District
with the following overlay conditions:
1. No more than 75% of the gross land area (98 acres) may be dedicated to multi-
family as a single use (includes entire Development Impact Area).
2. Karina Street must be extended to the west to connect to Brinker Road as a 50 -foot
road with 2 lanes and parallel parking with reduced speeds to be pedestrian friendly.
3. Brinker Road must be constructed as a 50 -foot road with 2 lanes and parallel
parking (total of 65 feet of right-of-way) with reduced speeds to be pedestrian
friendly.
4. Street trees are required between the curb and sidewalk at a rate of one per 30 linear
feet on average.
5. Legally parked parallel parking along Neighborhood streets may count toward
minimum parking for the abutting lot.
6. Loading areas, even those located along the rear of a lot must be screened with one
large canopy tree at mature growth, with a minimum 3.5" caliper, to grow at
maturity planted every 40 linear feet on average and a minimum three-foot high
continuous hedge of evergreen shrubs.
7. Multifamily Dwelling uses require that any ground floor fronting a Brinker Road
and Karina Street shall have a minimum wall height of 12 feet.
SECTION 3. The City's official zoning map is hereby amended to show the change in the
zoning district and use classification.
SECTION 4. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid by any court, such invalidity shall not affect the validity of the
provisions or applications, and to this end the provisions of this ordinance are severable.
SECTION 5. Any person, firm, partnership or corporation violating any provision of this
ordinance shall, upon conviction, be deemed guilty of a misdemeanor and shall be punished by
fine in a sum not exceeding $2,000.00 for each offense. Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense.
SECTION 6. That an offense committed before the effective date of this ordinance is
governed by prior law and the provisions of the Denton Code of Ordinances, as amended, in effect
when the offense was committed and the former law is continued in effect for this purpose.
SECTION 7. In compliance with Section 2.09(c) of the Denton Charter, this ordinance
shall become effective fourteen (14) days from the date of its passage, and the City Secretary is
hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -

Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the
date of its passage.
