MUNICIPAL. CORPOiU\TiON, AU'i-iiORIZIN(; 'I'IIE CI’I-Y MANAGI:R, OR 1-IIS
DESIGNEE. TO EXPEND 1:[NDS FOR PAYMENT OF THE ANNUAI_ WATER SYSTEM
FEE TO THE TI:XAS COMMISSION ON ENVIRONMENTAL QUALITY; AND,
PROVIDING AN EFFECTIVE DATE (WATER SYSTEM FEE IN TI-Ill 'i-o'rAL NOT-TO-
EXCEED AMOUNT OF $100.000.00).
WHEREAS, Texas Water Code, Section 5.103, and the Texas IIealth and Safety Code.
Section 341.041. require each public water system operator pay a water system fee (Public l-lealth
Service Fee) to the 'I-exas Commission on Environmental Quality (“TCEQ“) to cover costs of
inspections and enforcement of the Water Code with respect to public water systems; and
WIIEREAS, the City of Denton operates a public water system; therefore, the City of
Denton is required to pay such fees imposed by the TCI iQ; and
WI-IEREAS, the City Manager recommends that the City Council approve and authorize
the payment of these required fees to continue the operation of the City's public water system ; and
WIIEREAS, the City Council finds that it is in the best interest of the City to approve
payment of the annual water system fee, NOW, Tl--IEREFORE,
TIIE CITY COUNCIL OF TIIE CITY Ol: DEN’rON HEREBY ORDAINS:
SECTION 1. The recitals contained in the preamble of this ordinance are incorporated
into the body of this ordinance are true and correct.
SECTION 2. The City Mdnager. or his designec. after receipt of the annual invoice.
which is typically received in November. is authorized to expend funds in an amount not to exceed
$100.000.00 for payment to the TCEQ for the required annual water system fcc related to the
City's operation of its public water system
