DESIGNEE, TO EXPEND FUNDS FOR PAYMENT OF TIIE ANNU AIX WA’I-ER QU ALI’1-Y
FEE TO THE TEXAS COMMISSION ON ENVIRONMENTAL QUAI.1’1-Y FOR TIIE
OPERATION OF TI-IE CITY’S PECAN CREEK WATER RECiJAMA’riON PLAN’1-; AND,
PROVIDING AN EFFECTIVE DATE (CONSOLIDATED WATER QU ALI’I-Y FEE IN TI-IE
TOTAL NOT-TO-EXCEED AMOUNT OF $127,000.00).
WI-IEREAS, the Texas Water Code. Section 26.0291. requires each wastewater discharge
permit holder to pay a water quality fee to the ’l'exas Commission on Environmental Quality
(''1'CEQ”) to cover facility inspection costs and Water Code enforcement with respect to
wastewater facilities; and
WI-IEREAS. the City of Denton holds a wastewater discharge permit for the operation of
the City’s Pecan Creek Water Reclamation Plant and is required by law to pay an annual watt:1
quality fee to the TCEQ; and
WI-IEREAS, the City Manager recommends that the City Council approve and authorize
the payment of these required fees to continue the operation of the City’s Pecan Creek Watel
Reclamation Plant; and
WHEREAS, the City Council finds that it is in the best interest of the City to approve
payment of the annual water quality fee, NOW, TIIEREFORE,
rI-IE (_-'I'l'Y COUNCIL OF TIll i CITY OF DEN’1-ON IIEREBY ORDAINS:
SECTION 1. The recitals contained in the preamble of this ordinance are incorporated
into the body of this ordinance are true and correct.
SECTION 2. The City Manager, or his designec, after receipt of the annual invoice.
which is typically received in October, is authorized to expend funds in an amount not to exceed
$1279000.00 for payment to the TCEQ for the required annual water quality fee related to the
City’s wdstewdter discharge permit for the operation of the Pecan Creek Water Reclamation Plant.
