AN ORDINANCE OF THE CITY OF DENTON, TEXAS, NUNC PRO TUNC, CORRECTING
AN INADVERTENT MISTAKE IN ORDINANCE NO. 20-868, SPECIFICALLY THE
AWARDED VENDOR OF THE PROFESSIONAL SERVICES AGREEMENT WITH
ACP/GREEN + ASSOCIATES, LLC DBA PLANNING NEXT FOR THE PREPARATION OF
A COMPREHENSIVE PLAN EVALUATION REPORT AND TO UPDATE THE
COMPREHENSIVE PLAN; PROVIDING AN EFFECTIVE DATE (FILE 7196).
WHEREAS, on May 5, 2020, by Ordinance No. 20-828, the City Council approved an
ordinance with ACP/Green + Associates, LLC dba Planning Next, in the amount of $95,000; and
WHEREAS, the executed Ordinance No. 20-828 is not the correct and final version of the
ordinance as presented and approved by the Mayor; and
WHEREAS, due to an inadvertent clerical mistake, the executed Ordinance No. 20-828
establishes a contract in the amount of $95,000; and
WHEREAS, the City Council has the inherent power to retroactively correct such clerical
mistakes to reflect the truth of what was actually approved by the City when approving the
ordinance; and
WHEREAS, the City Council finds that the action taken herein is in the public interest;
NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference.
SECTION 2. The executed Ordinance No. 20-828 is hereby amended, to the limited extent
necessary, to correct a clerical mistake and accurately reflect the rejection of all proposals, (RFQ
7196) approved by the City Council for in the amount of $95,000.
SECTION 3. All other provisions of Ordinance No. 20-828 not specifically amended or
deleted herein shall continue in force and effect from the date of original passage on May 5, 2020;
SECTION 4. Effective Date. This ordinance shall become effective immediately upon its
passage and approval.
