20-2459ORDINANCE NO.20-2459 AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL CORPORATION, REJECTING ANY AND ALL COMPETITIVE PROPOSALS UNDER RFP 7215 FOR UTILITY SCALE SOLAR WITH ENERGY STORAGE FOR DENTON MUNICIPAL ELECTRIC. WHEREAS, the City has solicited, received, and tabulated competitive proposals to evaluate the potential for battery storage in the renewable energy supply portfolio (RFP 7215) in accordance with the procedures of state laws and the City’s ordinances; and WHEREAS, the City staff recommends, and the City Council has determined, that it is in the best interest of the City that the herein described proposals should be rejected; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. All competitive proposals, as described in the “Request for Proposal”, “Bid Proposals”, or plans and specifications on file in the Office of the City’s Purchasing Agent filed according to the bid number assigned herein (RFP 7215 – DME to evaluate the potential for battery storage in the renewable energy supply portfolio) are hereby rejected. SECTION 2. The City Manager, or his designee, is hereby authorized to execute all necessary documents for the rejection of said proposals. The City Manager, or his designee, is hereby authorized, in his discretion, to re-advertise to receive competitive bids, or proceed otherwise, to procure goods and services described in RFP 7215. SECTION 3. The City Council of the City of Denton, hereby expressly delegates the authority to take any actions that may be required or permitted to be performed by the City of Denton under the RFP 7215 to reject said proposals to the City Manager, or his designee. SECTION 4.
