20-2547ORDINANCE NO.20-2547 AN ORDINANCE OF THE CITY OF DENTON AUTHORIZING THE CITY MANAGER. OR HIS DESIGNEE, TO ACCEPT THE DENTON BENEFIT LEAGUE GRANT IN THE AMOUNT OF $7,307.71, FOR THE PERIOD OF DECEMBER 1, 2020 THROUGH JULY 1, 2021; AUTHORIZING THE CITY MANAGER TO CARRY OUT ALL DUTIES OF THE CITY PURSUANT TO THE GRANT; PROVIDING FOR THE EXPENDITURE OF FUNDS; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Denton Benefit League Grant will provide financial assistance toward expenditures related to the Young Reader Initiative grant program (the “Program”), including supplies, books, puppets, and marketing tools to provide persistent and sustainable access to materials for the public, and other miscellaneous expenses related to the Program’s goals and objectives; and WHEREAS, the City desires to expand and implement the 1,000 Books Before Kindergarten literacy initiative, which supports language development, early literacy skills, and relationship building for infants, toddlers, and preschool aged children; and WHEREAS, the funding of the Project will result in Denton families learning how to share the joy of reading and learning with young children, children developing language and literacy pronciencies, and continued reading and educational achievements once a child begins Kindergarten; and WHEREAS, the City Council finds it in the best interest of the citizens of the City of Denton to authorize the City Manager, or his designee, to accept the Denton Benefit League Grant in the amount of $7,307.71 from the Denton Benefit League for the period of December 1, 2020 through July 1, 2021; and WHEREAS, Denton Benefit League has provided the City with its Grant Memorandum of Understanding, attached hereto as Exhibit A, and the City Council finds that the Grant Memorandum of Understanding is acceptable and is in the public interest; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS : SECTION 1. The findings and recitations contained in the preamble of this Ordinance are incorporated herein by reference. SECTION 2. The City Council authorizes the City Manager, or his designee, to accept the Denton Benefit League Grant and execute the Grant Memorandum of Understanding attached as Exhibit A on behalf of the City. SECTION 3. The City Manager, or his designee, is further authorized to carry out all duties and obligations of the City under the Grant Agreement and to take such additional actions necessary and appropriate to effectuate the purpose of the grant, including but not limited to the expenditure of funds. SECTION 4. If any section, subsection, paragraph, sentence, clause, phrase, or word in this Ordinance, or the application thereof to any person or under any circumstances is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance, and the City Council of the City of Denton hereby declares it would have enacted such remaining portions despite any such invalidity. SECTION 5. Denton Benefit League - MEMORANDUM OF UNDERSTANDING This memorandum of understanding (MOU) constitutes a binding agreement between the Denton Benefit League (DBL) and City of Denton (Recipient) regarding grant funding in the amount of $7,307.71 which is being provided to Recipient for the sole purpose of: Grant Info Young Reader Initiative - 1,000 Books before Kindergarten. Supplies (folders, stickers, etc.), books, hand puppets branding/marketing items for use as a City of Denton Public Library program • The completed MOU must be returned to grants@)dentonbenefitleague.org no later than December 1, 2020 in order for the grant funding to be disbursed. • This MOU requires the signatures of the applicant and the Board Chair/President or Department Head. The recipient understands, covenants and agrees to the following: (initial next to each point) Grant funding must be used for the sole purpose described above and will be expended in exactly the manner described in the recipient’s application and as awarded. Grant funding may not be used for additional or different items or projects. Unauthorized use of the grant funding voids this MOU and the recipient shall return ALL of the grant funding to DBL. Using funds in other ways may result in the Grant Recipient being ineligible for future DBL Grant Awards for at least 1 year. If the entire amount of the grant funding is not needed for the purpose(s) named above, any unused portion of $100 or greater shall be returned to DBL no later than July 1, 2021 DBL shall receive acknowledgement as a donor/supporter in recipient’s publications and media releases. The DBL logo or name shall appear on recipient’s publicity and web site. Receipts and documentation verifying the expenditure of grant funding shall be returned to the DBL Grant Chair no later than July 1, 2020. Recipient shall also provide a report containing the following information: o The name and address of recipient. o The date and amount of the grant funding. o The purpose of the grant funding. o The amounts expended by recipient (with receipts and documentation verifying the expenditures) o A statement that no portion of the grant nrnding has been used for any purpose other than described above. Recipient agrees to allow DBL to review the expenditure of grant funding by site visit, to allow DBL to release news of the grant to the media, and to publish the recipient’s name/logo and/or photograph on DBL’s website. Recipient certifies that their organization has no outstanding liens, judgments, or defaulted indebtedness and is not under review by any government agency. Recipient certifies that this grant funding from DBL does not duplicate funding received for the same purpose from other sources Recipient understands that not adhering to the above requirements may render them ineligible for future DBL Grant awards for at least 1 year to be determined by the DBL Grant Committee and DBL Board of Directors.
