20-2561ORDNANCE NO.20-2561 AN ORDNANCE RATUYnqG THE EXPENDITURE OF FUNDS BY THE CITY MANAGER AND THE PURCHASING AGENT FOR THE PURCHASE OF EXCESS WORKERS’ COMPENSATION D{SURANCE COVERAGE FOR THE CITY OF DENTON AND AUTHORiznqG THE EXPENDrruRE OF ADDITIONAL FUNDS FOR SUCH PURPOSE, TFROUGH THE CITY’S SOLE BROKER OF RECORD, LOC'KTON COMPANIES, LLC,; AND PROVIDING AN EFFECTIVE DATE (FILE 7594 – AWARDED TO MDWEST EMPLOYERS CASUALTY COMPANY FOR A THREE (3) YEAR NOT-TO- EXCEED AMOUNT OF $830, 170.00). WHEREAS, Section 252.024 of the Local Government Code provides that a municipality may select a licensed insurance broker as the sole broker of record to obtain proposals and coverages for excess or surplus insurance that provides necessary coverage and adequate limits of coverage in structuring layered excess coverages in all areas of risk requiring special consideration, including public official liability, police professional liability, and airport liability; and WHEREAS, the City Manager has recommended to the City Council that it was necessary to purchase goods or services due to the following emergency conditions outlined in the memorandum referenced herein; and WHEREAS, the City’s insurance broker of record has obtained proposals and City Council wishes to procure excess workers’ compensation insurance coverage for a three (3) year period; NOW, THEREFORE, THE couNcn OF THE CITY OF DENTON HEREBY ORDAnqs: SECTION 1. The following purchase of materials, equipment or supplies, as described in the “File” listed hereon, and on file in the office of the Purchasing Agent, and the license terms attached are hereby approved: FILE NUMBER VENDOR AMOUNT 7594 Midwest Employers Casualty Company $830, 170.00 SECTION 2. The acceptance and approval of the above items shall not constitute a contract between the City and the person submitting the quotation for such items until such person shall comply with all requirements specified by the Purchasing Department. SECTION 3. The City Manager, or his designee, is authorized to execute any contracts relating to the items specified in Section 1 and to expend funds as required by such contracts. SECTION 4. The City Council of the City of Denton, Texas expressly delegates the authority to take any actions that may be required or permitted to be performed by the City of Denton under File 7594 for the emergency purchase of Excess Workers’ Compensation Insurance Coverage for the City of Denton, to the City Manager of the City of Denton, Texas, or his designee. SECTION 5. This ordinance shall become effective immediately upon its passage and approval.
