AN ORDINANCE OF THE CITY OF DENTON REPEALHqG ORDINANCE NO. 2008-129
RELATING TO SELF-FUELING OF ARCRAFT AT THE DENTON ENTERPRISE
AIRPORT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Ordinance No. 2008-129 established certain requirements for self-fueling of
aircraft at the Denton Enterprise Airport (“Airport”); and
WHEREAS, the requirements of Ordinance No. 2008-129 were also included in the
Airport Rules and Regulations and the Airport Minimum Operating Standards adopted pursuant
to Ordinance No. 20-240, including at Section 5-11., “Fuel storage tanks” of the Airport Rules
and Regulations; and
WHEREAS, the Federal Aviation Administration (“FAA“) has identified concerns with
certain of the Airport’s requirements related to self-fueling of aircraft, recommending that
Ordinance No. 2008-129 be repealed and an amendment be made to Section 5-11 of the Airport
Rules and Regulations; and
WHEREAS, in accordance with the FAA’s guidance and pursuant to Chapter 3-Airports,
Article II.-Rulemaking Authority, Section 3-201 of the Code of the City of Denton, Texas (the
“Code of Ordinances”), the Airport Manager proposed an amendment to Section 5-11 of the
Airport Rules and Regulations; and
WHEREAS, pursuant to Chapter 3, Article II., Section 3-202 of the Code of Ordinances,
at the December 10, 2020 meeting of the Airport Advisory Board, the Board approved the
amendment to Section 5-11 of the Airport Rules and Regulations and recommended that City
Council repeal Ordinance No. 2008-129 by a vote of 5 to 0; and
WHEREAS, at the December 22, 2020 meeting of the Council Airport Committee, the
Conmrittee recommended that City Council approve an ordinance repealing Ordinance No.
2008-129 by a vote of 2 to 0; and
WHEREAS, the City Council hereby finds that Ordinance No. 2008-129 relating to self-
fueling of aircraft at the Airport should be repealed; NOW, THEREFORE,
THE COUNCTL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this Ordinance are
incorporated herein by reference.
SECTION 2. Ordinance No. 2008-129 is hereby repealed.
SECTION 3. This Ordinance shall become effective immediately upon its passage and
approval.
