20-1228ORDINANCE NO. 20-1228 AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL CORPORATION, APPROVING A PRE-QUALIFIED LIST OF STATE CERTIFIED REAL ESTATE APPRAISERS TO PROVIDE REAL PROPERTY APPRAISAL SERVICES FOR REAL ESTATE FOR VARIOUS CAPITAL IMPROVEMENT PROJECTS WITHIN THE CITY OF DENTON; AND PROVIDING AN EFFECTIVE DATE (RFQ 7280 – FOR A THREE (3) YEAR TERM) WHEREAS, the City of Denton, Texas (“City”) desires to have a pool of qualified, approved appraiser firms from which the Real Estate Department can select appraisers for specific projects; and WHEREAS, on January 28, 2020, the City issued a Request for QualifIcations No. 7280, Pre-quali$ed Real Estate Appraiser ServIces (“RFQ”), for licensed appraisers to provide professional appraisal services for land and easement acquisitions in support of Capital Improvement Projects and City-wide initiatives, as detailed in the RFQ; and WHEREAS, in response to the RFQ, which was in accordance with the provisions of Texas Government Code, Chapter 2254, the City evaluated each submission on the basis of demonstrated competence and qualifications in accordance with selection criteria in order to determine the appraisers qualified to provide real estate appraisal services; and WHEREAS, the City staff has prepared a list attached as Exhibit A representing those appraisers whose qualifications are demonstrated to be the most advantageous to the City; and WHEREAS, selection of a professional appraiser on the prequalification list and awards of contracts shall be made on the basis of demonstrated competence and qualification to perform the services, and for a fair and reasonable price not to exceed any maximum provided by law, and contracts which exceed the City Manager’s delegation authority will be brought to the City Council in compliance with all procurement statutes and local ordinances; and WHEREAS, the City Council finds that the selection ofappraisers for the provision of real estate appraisal services, pursuant to the terms, conditions, and specifications contained in the RFQ, should be approved and is in the best interest of the citizens of the City of Denton; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The City Council of the City of Denton hereby approves the selection of professional real estate appraisers from the pre-qualified list attached hereto as Exhibit A and incorporated by reference herein, for the provision of Real Estate Appraisers for the City of Denton, pursuant to the Request for QualifIcations No.7280, Pre-QualifIed Real Estate Appraiser Services. SECTION 2. Any formal written agreement as a result of the acceptance, approval, and awarding from the pre-qualified list must be done in accordance with the procurement statues and local ordinances; provided that, the City Manager, or his designee, may take any actions that may be required or permitted to be performed within his previously delegated authority. SECTION 3. This ordinance shall become effective immediately upon its passage and approval.
