21-019ORDNANCE NO. 21-0 19 AN ORDNANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNiCnAL CORPORATION, AUTHORIZING THE APPROVAL OF A FRST AMENDMENT TO A PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF DENTON AND KIMLEY-HORN AND ASSOCIATES, INC., AMENDING THE CONTRACT APPROVED BY CITY COUNCE ON JANUARY 14, 2020, nq THE NOT-TO-EXCEED AMOUNT OF $922,800.00; SAm FRST AMENDMENT TO PROVIDE ADDITIONAL UTULITY CONFLICT ANALYSIS, SURVEYING, EASEMENT ACQUISITION, DESIGN, BiDDnVG, AND CONSTRUCTION ADMINISTRATION SERVICES IN SUPPORT OF THE STATE REn4BURS ABLE RELOCATION OF WATER AND WASTEWATER UTEITEES WITHUV THE nqTERSTATE HIGHWAY 35E RIGHT-OF-WAY; PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND PROVDUqG AN EFFECTIVE DATE (RFQ 6590-084 – PROVDnqG FOR AN ADDITIONAL FIRST AMENDMENT EXPENDITURE AMOUNT NOT-TO-EXCEED $ 165,000.00, WITH THE TOTAL CONTRACT AMOUNT NOT-TO-EXCEED $1,087,800.00). WHEREAS, on January 14, 2020, by Ordinance No. 20-040, the City awarded a contract to Kimley-Horn and Associates, Inc. in the amount of $922,800.00 to provide for utility conflict analysis, surveying, easement acquisition, design, bidding, and construction administration services in support of the State reimbursable relocation of water and wastewater utilities within the Interstate Highway 35E Right-of-Way; and WHEREAS, the additional fees under the proposed First Amendment are fair and reasonable and are consistent with and not higher than the recommended practices and fees applicable to the Provider’s profession and such fees do not exceed the maximum provided by law; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAPqS: SECTION 1. The First Amendment, increasing the amount of the contract between the City and Kimley-Horn and Associates, Inc., which is on file in the office of the Purchasing Agent, in the amount of One Hundred Sixty-Five Thousand and 00/100 ($ 165,000.00) Dollars, is hereby approved and the expenditure of funds therefor is hereby authorized in accordance with said amendment. The total contract amount increases to $1,087,800.00. SECTION 2. This ordinance shall become effective immediately upon its passage and approval.
