Temporary Side Path for New Denton High School—Over the past week,staff from Capital Projects/Engineering, Streets and Traffic Operations worked closely with Denton Independent School District (DISD) to make enhancements to an existing walking route along Bonnie Brae Street and Windsor Drive to serve the new Denton High School. At the intersection of Bonnie Brae and Riney Road, an interim all-way STOP control was installed, with future signalization planned in an upcoming capital project, along with school warning signs and advanced intersection traffic controls. At the intersection of Bonnie Brae and Windsor,updated pavement markings and signs were also enhanced. City and DISD crews are currently constructing a sidewalk connection along the south side of Bronco Way in advance of the first day of school, and a school crosswalk will be installed across Bonnie Brae Street at Bronco Way. A School Safety Speed Zone will be posted on Bonnie Brae Street and Bronco Way, which staff will present to City Council for their action at the August 16 meeting. State Lifeguard Games — On August 1, Denton Aquatics sent a competition team of lifeguards to Brenham, TX to compete at the State Lifeguard Games. This competition is invitation-only and celebrates the top four lifeguard agencies from each of the four regions in Texas. The City of Denton previously competed in its regional division along with 20 agencies at the North Texas Guard Games on July 22, where they took fourth place. Denton's team spent eight hours completing four mass-emergency challenges at the State Games this week where they placed I Ith overall across the state. Council Contingency Funds Update — On July 26, the City Council received a report on the use of Council Contingency Funds and provided direction that this funding would be consolidated with the existing sponsorship program beginning in Fiscal Year 2022- 2023. The amount of funding typically reserved for contingency funds will, using the sponsorship process, be held for small-cost programs or new events throughout the year. As with other sponsorship decisions, applications will be submitted for funding and reviewed by the Partnership Committee. Committee recommendations will then be sent to the full council for final approval. In preparation for this change, staff will review and, if needed, update program requirements and applications to accommodate this transition. Any pending requests for contingency funds or any requests received prior to the next fiscal year will be processed under the provisions of the current ordinance with the exception that the City Council will have final approval of the disbursement of funds. Any current fiscal year contingency fund requests must be submitted by Sept. 15, 2022. Staff contact: Christine Taylor, City Manager's Office D. Denton Police Department Achieves Accreditation Status — On Thursday, August 4, the Denton Police Department was notified it has achieved "Accreditation Status" for compliance with the Texas Police Chiefs Association (TPCA) Texas Law Enforcement Accreditation Program. The voluntary program evaluates a department's compliance with more than 170 best practices for Texas law enforcement, which were carefully developed to assist agencies in the efficient and effective delivery of service, the reduction of risk, and the protection of individual rights. For Denton PD, the accreditation process began in 2019 with a critical self-review of police policies,procedures, facilities, and operations. In 2 July 2022, TPCA-trained police chiefs conducted a final on-site review, which was a success. This was a lengthy process led by Accreditation and Compliance Specialist Dr. Richard Williams, with commendable contributions from all areas of the department. Denton PD will be recognized for this achievement on a date to be determined, as well as at the 2023 TPCA Annual Conference. Staff contact: Frank Dixon, Police E. Reminder Regarding Council Member Agenda Questions —To help provide agenda item- related information to the Council prior to consideration of agenda items,Council members may send questions on agenda items to staff. Staff will work to respond to any questions received prior to Monday morning by Monday evening or Tuesday morning at the latest and responses will be shared with all Council members. Fire Equipment Donation to Muzquiz — In May 2022, the City Council directed staff to explore the donation of used fire department equipment to Muzquiz,Coahuila,Mexico. On May 5,2015,Muzquiz became Denton's official Friendship City, or ciudad amiga. The fire department has identified 15 sets of protective gear along with various equipment that has aged out of service. In lieu of including the expired supplies to be disposed of in the city's auction process. The fire department will make contact the with Muzquiz fire service to determine if any equipment would be helpful. If so,the Fire Department will begin working the Procurement staff to begin the donation process.Additionally, staff were also requested to place signs noting our friendship city relationship with Muzquiz at roadway entrances into the City. Teen Council 2022-2023 — The staff at Denia Recreation Center are reinstating Teen Council this Fall with the mission to inspire teens from all backgrounds to become active members of their community and make a difference. Teen Council's goal is to show teens new perspectives on their role in the community and youth-related issues through research, peer discussions, and community interactions. The program will begin in October 2022 and continue through May 2023,with meetings held on the second Tuesday of each month, excluding DISD holidays. Teens ages 14-18 may express their interest and receive an application by registering for the program online or at any Denton recreation center. The deadline to apply is Monday, August 29. Sessions will include topics on community service, fundraising, and event opportunities. Staff contact: Megan Thomas, Parks and Recreation H. Council Meeting Spanish Interpretation Update—During the FY 2021-22 budget process, City Council approved funds for live Spanish language interpretation for Council meetings at City Hall. The final testing of this outreach enhancement, both live and recorded, took place during the August 2 meeting without issue. Moving forward, every regular City Council meeting will have live Spanish interpretation available beginning at 6:30 p.m. Staff will promote this option leading up to the August 16 meeting. Fire Sprinkler Grant Program — At the July 26 City Council meeting, Council Member Davis shared a two-minute pitch asking staff to"recommend the Downtown TIRZ#1 board and the Downtown Economic Development Committee consider implementing a grant program for fire sprinkler installation in older buildings in our historic downtown,modeled on our existing business grant program." This has been placed on upcoming TIRZ and DEDC agendas for discussion. Staff contact: Wayne Emerson, Economic Development B. Repairs on TxDOT Roadways, Railroad Crossing at McKinney Street, and Hummingbird Lane — On August 2, Mayor Hudspeth inquired with staff on behalf of two residents concerned about several Texas Department of Transportation(TxDOT)roadways, one city roadway, and the railroad crossing at McKinney Street. Staff met with Union Pacific Railroad(UPRR) on August 2 to discuss the Downtown Quiet Zones along with the recent repair to the roadway that UPRR performed just east of the crossing on McKinney Street due to the removal of an unused side-track. UPRR is aware of the poor condition of the pavement around the railroad tracks and staff is working with UPRR at this intersection to ensure they make the proper repairs. At a meeting with TxDOT on August 4, the issues regarding the pavement on both Eagle Drive and South Elm Street were again discussed and the City requested that TxDOT repair both sections as soon as possible. The City of Denton does not perform repairs on either road as they are under TxDOT jurisdiction. As stated in the Friday report on July 22, Capital Projects/Engineering staff is currently working with Denton County and TxDOT on the next steps for Elm and Locust which will include an agreement between all three parties. Staff is working with Public Works to assess the condition of Hummingbird Lane and determine if immediate repairs are required. Dallas Drive SUP — Mayor Hudspeth inquired as to the status of a Specific Use Permit (SUP) for 715 Dallas Drive (Akers Towing) due to concerns expressed by the property owner that they cannot sell their business due to the use being granted specifically to the owner or immediate family member to operate the business. Additionally, there are drainage improvement requirements tied to the property as a result of confirmed contaminants leaving the site and entering the watershed. The SUP was originally granted to allow wrecker services and an impound lot for the 1.3- acre subject property on August 5, 2014 (Ordinance 2014-240). In September 2014, staff determined that contamination was likely exiting the property and pursued enforcement with the property owner including initiating the revocation of the SUP. However, the city continued to work with the property owner throughout the remainder of 2014 and 2015 to allow for best management practices to be installed for the site, and an SUP amendment was granted on December 15, 2015 (Ordinance 2015-390) including establishing new conditions related to compliance with the site's stormwater management plan. This 2015 SUP amendment was also tied to the property owner and individuals who are related to the owner by consanguinity or affinity, both in the first degree. The SUP is not allowed to run with the land; therefore, selling the business and property outside the aforementioned familial requirements will cause the SUP to expire. 4 For the current property owner to sell the business and property while continuing its current use, a new SUP will be required. The property is zoned Light Industrial (LI)which allows impound lots subject to approval of an SUP. The new SUP is subject to receiving a recommendation from the Planning and Zoning Commission, and approval by City Council. Staff contacted the current property owner on August 3,advised them of the above findings, and explained the SUP application process and use specific standards; a follow- up email will also be sent to the property owner. Staff contact: Tina Firgens, Development Services D. City Salaries — On August 2, Council Member McGee inquired about City staff base salaries under$40,000 per year. As of August 2, out of 1516 current full-time employees, 94 employees make a base salary below $40,000 with overtime, differentials, etc. not included. While several departments have employees whose base salary is below $40,000, affected employees are primarily in positions such as field service workers, heavy equipment operators, and customer service. Staff contact: Deby Skawinski, Human Resources E. Solar Rebates— On July 29, Mayor Pro Tem Beck inquired on solar rebate programs and changes with Denton Municipal Electric (DME) and Sustainability. On July 30, Council Member Maguire also inquired about the topic. DME and Sustainability staff are finalizing a GreenSense Program Update that is planned for presentation at the Sustainability Committee this coming month, then to the Public Utilities Board(PUB) and Council. Staff are closely following the Inflation Reduction Act and the affected solar rebate tax credits, as well as potential tax credits that would apply to public utilities for generation and storage projects. DME is working with an external firm to monitor these and other developments and funding opportunities. Staff contact: Tony Puente, DME F. Quakertown History and Commemoration — On August 1, Council Member Byrd shared information from a resident with desired plans for Quakertown and commemoration of Quakertown residents. During the Quakertown Work Session scheduled for September 20, Parks and Recreation will cover the two requests from a previous two-minute pitch: the feasibility of renaming the Women's Building and options for the commemoration of the Quakertown residents. The discussion on commemoration will include various options including the feasibility of in-ground markers. Parks and Recreation staff will reach out to the resident to obtain feedback,which will also be incorporated into the presentation. Yappy Hour at North Lakes Dom— The Denton Parks Foundation is hosting Yappy Hour from 6 p.m. to 9 p.m. at North Lakes Dog Park on Friday, August 5. Alcoholic beverages will be available for purchase from Denton County Brewing Company, Bondi Bowls Food Truck, and the Pet Treat Truck will be on-site to sell treats to humans and their furry friends! Back-to-School Volunteer Opportunities — Denton Independent School District (DISD) supplies more than 5,000 students with school supplies to equip them for the new school year. Sip online to volunteer at one of two in-person volunteer opportunities with DISD on Saturday, July 30, at Braswell High School, and Saturday, August 6, at Ryan High 5 School. DISD also needs backpacks prior to the volunteer dates. Free Fan Distribution — Denton Municipal Electric (DME) and Sustainable Denton, through the GreenSense Energy Efficiency Program, are providing up to 1,000 20" air circulator floor fans to DME customers. Floor fans are portable, energy efficient, and can improve comfort by making you feel cooler during extreme heat. Fans cost pennies per month to operate and when circulating air can help residents feel several degrees cooler. Fans will be available for pick up Monday, August 8, through Friday, August 12, from 8 a.m.to 6 p.m. at the City of Denton Sustainability Office at 1001 S. Mayhill Rd. A fan distribution event will also be held at the Martin Luther King Jr. Recreation Center located at 1300 Wilson St. from 9 a.m. to noon on August 13. Street Construction Report.................................................................................................37 6 August 5,2022 Report No. 2022-045 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: Tribute to Abner Haynes and Dr. Leon King EXECUTIVE SUMMARY: In September 2021, City Council directed the Parks and Recreation Department to work with the Public Art Committee to determine the feasibility of commissioning a sculpture honoring Abner Haynes,a former North Texas State Athlete.Mr.Haynes was one of two African American players that broke the color barrier in 1956 while playing football for North Texas State University (NTSU), now the University of North Texas (UNT). Mr. Haynes went on to break records in professional football eventually retiring from the New York Jets in 1967. Dr. Leon King,who also integrated the NTSU football team in 1956,went on to earn his doctorate and serve as a public-school teacher, coach, assistant principal, and principal. In 2016, Dr. King was inducted into the African American Education Archives and History Program (AAEAHP) Hall of Fame for his for his enduring service to the Dallas Independent School District.While staff researched the players' history, they learned that the UNT Athletics Department was already working on a project called "Unity Plaza" that will house sculptures of both Abner Haynes and Dr. Leon King. Unity Plaza will be located next to the UNT athletic offices near Apogee Stadium. BACKGROUND During the September 21, 2021, City Council meeting, Council Member Davis presented a one- minute pitch to hold a work session exploring the feasibility of commissioning a statue honoring Abner Haynes. Mr. Haynes was one of the first African American students to play football for NTSU. Abner Haynes was born in Denton in 1937, but his family moved to Dallas before he started playing football. Mr. Haynes returned to Denton with his friend and teammate Leon King to play football at NTSU in 1956. They were two of the 14 Lincoln High School classmates enrolled at NTSU and the only two African American players on the team. Mr. Haynes excelled as a running back on the football team and holds records in punt return average that still stand. Haynes was later drafted and played for the American Football League (AFL)with the Dallas Texans (known now as the Kansas City Chiefs). He led the AFL in rushing in his rookie year and still holds the AFL record in combined yards. Leon King did not continue to a professional career in football,but instead found his calling in the classroom. After earning his undergraduate degree, King continued to earn a Master of Education degree from NTSU in 1972. He ultimately earned a doctoral degree as well and served as an inspiration to many during his decades-long career within the Dallas Independent School District. August 5,2022 Report No. 2022-045 Haynes and King were stars on the football field,but their greatest achievements were in breaking the color barrier on the NTSU football team, inspiring and easing the way for those who would follow in their footsteps. UNT already established the location and a$250,000 budget for the project. The estimated costs have since grown to $360,000. UNT staff also noted they are looking for partners to fully fund the project. UNT originally asked if the City could contribute $100,000. Their current funding shortfall is $190,000. UNT staff noted the City would be recognized for this contribution on a plaque at the site. Unity Plaza will be located on the UNT campus outside the athletics offices south of Apogee Stadium. The project has already broken ground and UNT's website estimated the project will be completed in early to mid-fall. The City Manager's Office has identified the availability of up to $100,000 in the FY2022-2023 budget that could be allocated for this project. Staff plans to place this item on a future agenda to allow City Council to discuss the level of interest in support of this public art project. 'We are excited to honor the contributions of two icons of our university and the state of Texas in Abner and Leon;Vice President and Director of Athletics Wren Bakersaid. This Unity Plaza will be a focal point of our athletics facilities and somewhere that will live on for generations celebrating the achievements of two of our finest alumni: The plaza will be constructed adjacent to the UNT Athletic Center and the Lovelace and McNan Families Practice Facility.It will prominen*feature both men's names along with plaques honoring their vast accomplishments In 1956,Haynes and Dr.King became the first Black student-athletes to play major college football in Texas when they became members of the North Texas freshman team-Both would move to the varsity as sophomore in 1957. He was inducted into the African American Education Archives and History Program Hall of Fame following more than four decades of service as a teacher,coach,and administrator in Dallas Independent School District. Haynes,a member of the UNT Athletics Hall of Fame,the Texas Sports Hall of Fame and the UNT All-Century Team,led the Mean Green in rushing three times and was twice a Missouri Valley All-Conference honoree.He led UNT to a 1959 Sun Bowl appearance,and Time magazine named him an All-American. In 1960,he was drafted in the first round by the AFLs Dallas Texans,now the Kansas City Chiefs.Haynes went on to a play eight seasons of pro football and was named the AFL MVP in 1960-He was a four-time AFL All-Star and in 1991 was inducted into the Kansas City Chiefs Hall of Fame- His No.28 jersey was also retired by the franchise.
