21-397FILE REFERENCE FORM X Additional File Exists Additional File Contains Records Not Public, According to the Public Records Act Other FILE(S) Ordinance establishing the schedule of rates wastewater service 19-2137 Amended by 21-397 Date Initials 09/17/2019 03/02/2021 CW CW ORDINANCE NO. 21-397 AN ORDINANCE OF THE CITY OF DENTON AMENDING ORDINANCE 19-2137 TO CHANGE THE CALCULATION OF WASTEWATER VOLUME IN SCHEDULES SR AND SMH FOR MARCH 2021 THROUGH FEBRUARY 2022; AND PROVIDING AN EFFECTIVE DATE WHEREAS, on February 12, 2021, Governor Greg Abbott certified that severe winter weather poses an imminent threat of widespread and severe property damage, injury and loss of life due to prolonged freezing temperatures, heavy snow, and freezing rain statewide and declared a state of disaster for the entire state; and WHEREAS, on February 14, 2021 President Biden approved the Texas Severe Winter Storm disaster declaration (EM-3554-TX) for the state of Texas; and WHEREAS, on February 15, 2021 Mayor Gerard Hudspeth, declared a local disaster due to the severe winter storm posing an imminent threat of widespread and severe property damage, injury and loss of life due to prolonged freezing temperatures, heavy snow, and freezing rain in the City of Denton; and WHEREAS, on February 19, 2021 Mayor Gerard Hudspeth, declared a local disaster due to the energy emergency posing an imminent threat of widespread and severe property damage, injury, and loss of life due to power outages and prolonged freezing temperatures in the City of Denton; and WHEREAS, the severe weather moved into the City of Denton beginning February 14, 202 1 and resulted in unprecedented demand for electrical power, damage to water utility infrastructure, and unsafe infrastructure within the City, threatening the safety and lives of all residents; and WHEREAS, the combination of winter weather, including freezing temperatures and accumulation of ice and snow, electricity outages, and rolling blackouts created conditions that caused customers’ water pipes to freeze; and WHEREAS, on February 23, 2021, Council adopted Ordinance 21-361 extending the Declaration of Local Disaster and approving the Mayor’s Update Order, wherein the City provided an alternate means of calculating the wastewater usage for Schedules SR and SMH under Ordinance 19-2137; and WHEREAS, Council desires that the alternate calculation for wastewater usage from Ordinance 21-361 apply through February of 2022; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The facts, circumstances, and recitations contained in the preamble of this Ordinance are found and declared to be true and correct, and are incorporated herein by reference as if fully set out herein. SECTION 2. This language shall be added to Schedule SR as shown in Exhibit A, attached: The calculation of winter Average Daily Usage for each customer from March 2021 through February 2022 shall be based on their December 2020 and January 2021 water consumption if that results in a lower wastewater volume than the wastewater volume in effect for the customer on February 23, 2021; otherwise the wastewater volume in place on February 231 2021 will be used. SECTION 3. This language shall be added to Schedule SMH of Ordinance 19-2137 as shown in Exhibit B, attached: The calculation of winter Average Daily Usage for each customer from March 2021 through February 2022 shall be based on their December 2020 and January 2021 water consumption if that results in a lower wastewater volume than the wastewater volume in effect for the customer on February 23, 2021; otherwise the wastewater volume in place on February 23, 2021 will be used. SECTION 4. The amendments adopted herein shall be effective, charged, and applied as provided in the amendment beginning March 2, 2021, and these amendments shall be incorporated into the copy of rates, fees, and charges maintained on file in the Office of the City Secretary of the City of Denton, Texas. Also applicable for wastewater service without City of Denton, Texas water service. Not applicable for sub-billing or other utility billing by service user in any event. The average daily usage may be calculated using as few as two months. The Average Daily Usage thus calculated establishes the wastewater volume charge for each subsequent month, through the following February. The calculated wastewater billed volumes will be capped at a maximum of 18,000 gallons/bill. The calculation of winter Average Daily Usage for each customer from March 202 1 through February 2022 shall be based on their December 2020 and January 202 1 water consumption if that results in a lower wastewater volume than the wastewater volume in effect for the customer on February 23, 202 1; otherwise the wastewater volume in place on February 23, 2021 will be used. For customers without an established winter Average Daily Usage water consumption billing history derived from the preceding billing months of December through February, wastewater volume for each billing month through the following February shall be calculated at 100% of 5,400gallons. MINIMUM BILLING - WITH CITY OF DENTON WATER SERVICE Facility Charge EXHIBIT A VOLUME CHARGE - WITH CITY OF DENTON WATER SERVICE With a current Average Daily Usage, billings through the following February shall be based on the average daily usage calculated using the following formula. Current Average Daily Usage x Rate per 1,000 gallons 1 ,000 For customers without an established current Average Daily Usage, billings shall be based on 100% of 5,400 gallons. 5,400 Gallons x Rate per 1,000 gallons 1 ,000 PAYMENT Bills are due when rendered, and become past due if not paid within fifteen (15) calendar days from date of issuance. SPECIAL FACILITIES All services which require special facilities in order to meet Customer's service requirements shall be provided, subject to the Special Facilities Rider. EXHIBIT B SCHEDULE SMH MOBILE HOME PARK WASTEWATER SERVICE (Effective 10/01/19) APPLICATION Applicable for mobile home parks that are master water metered to provide residential wastewater service. Wastewater service is billed based on the Customer’s winter average water usage. Also applicable for wastewater service without City of Denton water service, in the event the mobile home park does not have a master meter for wastewater. Wastewater service is billed on the average residential wastewater volume per customer. Not applicable for sub-billing or other utility billing by service user in any event.
