AN ORDINANCE OF THE CITY OF DENTON, TEXAS REGARDING A REZONING FROM RESIDENTIAL RURAL (RR) DISTRICT TO PLANNED DEVELOPMENT (PD) DISTRICT ON AN APPROXIMATELY 62.39-ACRE PROPERTY IS GENERALLY LOCATED ON THE NORTH SIDE OF HICKORY CREEK ROAD AND THE SOUTH SIDE OF CREEKDALE DRIVE, APPROXIMATELY 600 FEET WEST OF RIVERPASS DRIVE, IN THE CITY OF DENTON, DENTON COUNTY, TEXAS; ADOPTING AN AMENDMENT TO THE CITY’S OFFICIAL ZONING MAP; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF; PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. (PD20-0009a; Parkside) WHEREAS, Jerry Sylo ofJBI Partners, Inc, applied on behalf of the property owner, Estate of Ernest Dewey Calvert, for a zoning change from Residential Rural (RR) District to Planned Development (PD) District on approximately 62.39 acres of land, legally described and depicted in Exhibit “A“ (hereinafter, the “Property”); and WHEREAS, on June 9, 2021, the Planning and Zoning Commission, in compliance with the laws of the State of Texas, have given the requisite notices by publication and otherwise, and have held due hearings and afforded full and fair hearings to all property owners interested in this regard, and have recommended approval (5-0) of the change in zoning classification of the Property to Planned Development (PD) District; and WHEREAS, on June 15, 2021, the City Council likewise conducted a public hearing as required by law, and finds that the request meets and complies with all substantive and procedural standards for a zoning change to Planned Development (PD) District set forth in Section 2.7.3 of the Denton Development Code, and is consistent with the Denton Plan 2030 and the Denton Development Code; and WHEREAS, the Planning and Zoning Commission and the City Council of the City of Denton, in considering the application for a change in the zoning classification of the property, have determined that the proposed use is in the best interest of the health, safety, morals, and general welfare of the City of Denton, and accordingly, the City Council of the City of Denton is of the opinion and finds that said zoning change is in the public interest and should be granted as set forth herein; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAFNS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference and found to be true. SECTION 2. The zoning district and use classification for the Property is hereby changed from Residential Rural (RR) District to Planned Development (PD) District. The Development Standards for the Property are described in Exhibit “B” attached hereto and incorporated herein by reference, and the PD Development Plans depicting the proposed development layout for the Property is provided in Exhibit “C”, Exhibits “C-1 ” through “C-4”, Exhibit “D”, and Exhibit “E” attached hereto and incorporated herein by reference. Development of the Property shall be in accordance with the Development Standards in Exhibit “B” and the Development Plans in Exhibit “C”, Exhibits “C-1 ” through “C-4”, Exhibit “D”, and Exhibit “E.” SECTION 3. The City’s official zoning map is hereby amended to show the change in the zoning district and use classification. SECTION 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of the provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 5. Any person, firm, partnership or corporation violating any provision of this ordinance shall, upon conviction, be deemed guilty of a misdemeanor and shall be punished by fine in a sum not exceeding $2,000.00 for each offense. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 6. In compliance with Section 2.09(c) of the Denton Charter, this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record- Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage. Parkside will be developed utilizing the Cluster Subdivision concept and the R6 Residential development standards. The cluster subdivision option is being implemented in order to protect sensitive lands and common open space areas. As can be seen on the attached Concept Plan, (Exhibit D) the vision for the Parkside neighborhood is to develop the upland portion of the property while leaving the flood plain in its natural state GENERAL STANDARDS 1.The design and development of the Parkside neighborhood shall take place in general accordance with the attached Development Plan (Exhibit C) and Concept Plan (Exhibit D). The land uses which would be allowed per the Concept Plan are Single-Family Detached Dwellings, Park, Playground, and Open Space. If uses other than those are to be developed on this property, a rezoning to accommodate those uses would be required. Unless otherwise specified in this planned development, development within the Parkside neighborhood is governed by the Denton Development Code (DDC) as currently enacted at the time of approval of this ordinance by the City Council. In the event of any conflict or inconsistency between these standards and the applicable City regulations, the terms and provisions of this planned development shall apply. In the event of a conflict between the written text and the illustrations provided in this planned development, the written text contained herein shall control. The maximum number of homes in the Parkside neighborhood shall be 156. A minimum of 23 AC located within Tract 2 shall be dedicated to the City for public park land. This shall include approximately 5 AC of Upland property and approximately 18 acres of Flood Plain property . A 10’ wide multi-use path shall be provided along Creekdale Drive per the cross section identified on Exhibit C (Development Plan). Homeowners Association (HOA) A. A mandatory Homeowners Association will be responsible for the maintenance of lots owned by the HOA. Approximately 0.8 acres are intended to be owned and maintained by the HOA as shown on Exhibit E. 2. 3. 4 5. 6. 7. DEVELOPMENT STANDARDS SINGLE FAMILY (TRACT 1)1. Uses Permitted uses allowed in Tract 1 shall be all principal and accessory uses which are allowed by right in the (R6) Residential District, in accordance with Table 5.2-A: Table of Allowable Uses of the Denton Development Code, as it exists or may be amended, with the following exceptions. Gas Well Use specific standards apply as indicated in Table 5.2-A of the DDC. A Specific Use Permit shall be required for all uses otherwise requiring a Special Use Permit in the (R6) Residential District, in accordance Table 5.2-A: Table of Allowable Uses of the Denton Development Code, as it exists or may be amended. with the following exceptions. The following uses shall be prohibited. 1. Manufactured Home Development (HUD Code) 2. Elderly Housing 3. Group Home 4. Club or Lodge 5. Day Care, Adult or Child 6. School, Private 7. RV Park 8. In coordination with the above screening, landscaping shall be provided. Said landscaping shall be maintained by the HOA. Trails will be provided within Tract 2 as well as other recreational facilities. The boundary of the tract will be delineated with permanent signage markers. The specific design of recreational elements within Tract 2, as well as any signage shall be developed in coordination with the Denton Parks Department and will be done prior to approval of the final plat for the neighborhood. 2.
